WYSOCKI: This is in the matter of the 2 Squaw Bar. Both gentlemen are present. You received 3 a copy of the complaint and notice of hearing, 4 correct? 5 MR. BRYAN BOSACK: Yes, sir. 6 MR. ERIC BOSACK: Yes, sir. 7 MR. WYSOCKI: And you understand what you're 8 being charged with, overserving? 9 MR. BRYAN BOSACK: I didn't see the 10 overserving but -- 11 MR. WYSOCKI: That's what it is. 12 MR. BRYAN BOSACK: Okay. I see it now. 13 Okay. 14 MR. WYSOCKI: And are you pleading guilty or 15 not guilty to the charge? 16 MR. BRYAN BOSACK: Not guilty. 17 MR. WYSOCKI: Okay. Are you going to have 18 an attorney represent you today? 19 MR. ERIC BOSACK: No. 20 MR. WYSOCKI: So all those that are going to 21 testify I need you to raise your right hand. 22 (PEOPLE WERE SWORN) 23 MR. WYSOCKI: Gentlemen, what will happen is 24 that Officer Kaiser will testify first, then you can DEPOSITION REPORTERS 3 (847) 356-6834 1 ask him any questions that you have and then you can 2 make your statements after that. All right. Officer 3 Kaiser, would you state your name please? 4 A. Keith Kaiser, K-A-I-S-E-R. 5 Q. And you were part of the investigation on 6 August 7, 2010 for the Squaw Bar, correct? 7 A. Correct. 8 Q. And were you dispatched? 9 A. I overheard the radio traffic and responded 10 to the address in Round Lake Beach. 11 Q. And what happened when you went to Round 12 Lake Beach? 13 A. I spoke with Deputy Forlenza who told me 14 that he had responded to the Squaw Bar for a domestic 15 battery which had occurred in the parking lot. 16 Q. And did he indicate to you as far as what 17 had occurred at the Squaw Bar? 18 A. That Colleen and Raymond Checka (Phonetic) 19 were inside the bar. She wanted to leave and Raymond 20 wanted to continue drinking. They went outside into 21 the parking lot where Raymond battered Colleen. 22 Raymond then left the bar in his vehicle, drove home. 23 Colleen sustained minor injuries. She was not 24 transported to the hospital. DEPOSITION REPORTERS 4 (847) 356-6834 1 She gave a statement about the battery to 2 Deputy Forlenza. Colleen was extremely intoxicated 3 at the time. She was -- had difficulty walking. She 4 had slurred speech. Her eyes were extremely 5 bloodshot. And she told us that Raymond was also 6 intoxicated and drove the vehicle home. 7 We went to the residence in Round Lake Beach 8 and eventually Raymond was taken into custody for 9 domestic battery and he was intoxicated as well. 10 Q. What did you notice about him? 11 A. He was quite intoxicated. He had 12 difficulties walking. He was very uncooperative. 13 Q. Okay. Do you have any questions of the 14 officer? 15 MR. BRYAN BOSACK: The only question I had I 16 guess was I mean he was charged with a Class A 17 misdemeanor for domestic battery, but he did not 18 receive any tickets for drunk and disorderly conduct 19 or anything like that? Did he get any tickets? 20 A. No. 21 Q. Okay. So I'm just trying to see how we can 22 be guilty of overserving if there was no tests given. 23 A. In Lake County when you're driving, you 24 normally have to be found behind the wheel of a DEPOSITION REPORTERS 5 (847) 356-6834 1 vehicle. In this case he had made it home and he was 2 passed out in bed by the time that we got there. So 3 and, you know, I think domestic battery is more of a 4 serious -- 5 MR. BRYAN BOSACK: Yes, most definitely 6 without a doubt. 7 MR. ERIC BOSACK: These people have a 8 history of domestic with each other. 9 MR. BRYAN BOSACK: These people have been 10 barred from the bar. 11 MR. WYSOCKI: Do you want to go ahead and 12 tell us your side then? 13 MR. BRYAN BOSACK: I'm not as aware of this 14 as much as my brother is here. So my brother, Eric. 15 MR. ERIC BOSACK: I got a phone call -- 16 MR. WYSOCKI: State your name. 17 MR. ERIC BOSACK: My name is Eric Bosack. 18 I'm the manager. I was at Fiesta Days right in town 19 in Fox Lake. I received a phone call from Chris that 20 helps out over there with saying that there was a 21 woman sitting in the back crying saying that her 22 husband had pushed her down and took her truck. 23 And I'm like, okay, when did this 24 happen, is this still going on right now. He's like, DEPOSITION REPORTERS 6 (847) 356-6834 1 no, it happened a while ago and he walked outside and 2 she was sitting there. And she asked him to call the 3 police. And I'm like it already happened, is she -- 4 was she badly injured or anything? He was like, no, 5 there's a little blood running from her arm. I'm 6 like, okay, then don't waste the officer's time right 7 now. That's all I know that she refused the 8 ambulance and everything else. 9 And that then I found out -- I talked 10 to them. They do have a history of domestic with 11 each other. And they're volatile so I asked them not 12 to come to the bar anymore. 13 Q. Did you talk to Chris or as far as how much 14 they had to drink at your location? 15 A. They weren't there that long. From -- 16 Because Missy Jeffers was the bartender on duty. She 17 is Basset certified and she knows not to overserve. 18 She's good like that. She said they weren't there 19 that long. They were drinking. I'm not sure how 20 much, but she said they got into an argument. They 21 were like, I guess she stated that they were arguing 22 before they came in. Well, as they were coming in. 23 So I don't know. Maybe a few cocktails lit them up 24 like that. So -- But it was like I said they have a DEPOSITION REPORTERS 7 (847) 356-6834 1 history of domestic with each other. 2 MR. WYSOCKI: Okay. 3 MR. ERIC BOSACK: So I just said, no, no 4 problem, I don't want them in there anymore. 5 MR. WYSOCKI: Okay. Anything else that you 6 want to say? 7 MR. ERIC BOSACK: No. That was -- I just 8 figured it was after the fact, after everything 9 happened and she was outside crying and then she 10 wanted the police. So -- 11 MR.
