· The department operates and maintains a water tower at Grandwood Drive and Hutchins Road.

· This easement agreement establishes the terms and provisions by which New Cingular Wireless must repair, maintain and replace the fiber optic cable.
· This resolution authorizes the execution of an easement agreement between the County and New Cingular Wireless.

RESOLUTION
WHEREAS, Lake County owns and operates a water tower at Grandwood Drive and Hutchins Road, which is part of the Grandwood Park water system ; and
WHEREAS, the County and New Cingular Wireless PCS, LLC have previously executed a lease agreement, which allowed New Cingular Wireless to locate cell antenna facilities at the County's Grandwood Park water tower site; and
WHEREAS, as part of the cell antenna facilities, New Cingular Wireless installed a fiber optic cable that was not within the existing easement; and
WHEREAS, an Easement Agreement must be executed between the parties to establish the terms and provisions for an easement for the on-going repair, maintenance and replacement of the fiber optic cable; and
WHEREAS, execution of an Easement Agreement must be authorized by Resolution of this County Board;
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the County's Director of Public Works is hereby authorized to execute the attached Easement Agreement between the County and New Cingular Wireless PCS, LLC.
