R E S O L U T I O N

 

WHEREAS, Lake County is the owner of a parcel of land, 81.011 acres, Pin # 03-03-300-007 that is situated along Russell Road east of I-94/US Rte. 41, in unincorporated Lake County; and

 

WHEREAS, a portion of said county parcel is now needed by the Illinois Department of Transportation, IDOT, for their future improvement of the interchange of I-94/US Rte. 41 at Russell Road; and the portion of said county parcel is 0.017 acres identified by IDOT as Parcel No. 1H80103 and is situated immediately adjacent to Russell Road, in unincorporated Lake County, as depicted in the Plat of Highways attached hereto and denoted as Attachment A; hereinafter the Russell Road parcel; and

 

WHEREAS, the Public Works and Transportation Committee has determined that the best interest of Lake County would be served by conveying to the State of Illinois, Lake County’s interest in said Russell Road parcel; and

 

WHEREAS, pursuant to the Local Government Property Transfer Act, 50 ILCS 605/4, the county may transfer all of its right, title, interest in the said Russell Road parcel to the State of Illinois acting by and through its Department of Transportation, IDOT, upon such terms as may be agreed upon by the corporate authorities of the county and IDOT and subject to the provision of such act; and

 

WHEREAS, IDOT’s appraised value and compensation offer to Lake County and for the county to relocate a portion of the existing fence for said Russell Road parcel is $6,500.00; and

 

WHEREAS, pursuant to the 765 ILCS 5/16 the County Board may authorize its County Board Chair to convey real estate belonging to it.

 

NOW, THEREFORE BE IT RESOLVED BY this County Board of Lake County, Illinois, that the County Board Chair, the County Clerk, and the County Engineer on behalf of Lake County be authorized and they are hereby directed to execute whatever documents are necessary to effectuate such conveyance and transfer of the said Russell Road parcel to the State of Illinois, IDOT.

 

BE IT FURTHER RESOLVED that the County Engineer shall transmit in writing the right of way conveyance documents to be executed and provide for conveyance of the payment for damages to the appropriate county office for their relocation of a portion of said fence.
