Staff Summary

                     Butterfield Road and IL Rte 60 and the CNRR: IDOT Agreement.

                     The County has been allocated federal funds for work on Butterfield Road at IL Rte 60 and the CNRR, and IDOT administers all federal highway funds.

                     This agreement provides for the County to receive up to 80% reimbursement for the costs of Phase I preliminary engineering by obligating the funds.

                     This agreement will give the County up to one year to initiate engineering for the improvement of Butterfield Road at IL Rte 60 and the CNRR or have the funds reallocated to a different project.

 

Body

R E S O L U T I O N

 

WHEREAS, Butterfield Road, County Highway 57, is a designated route on the county highway system; and

 

WHEREAS, for the free flow of traffic on Butterfield Road at IL Rte 60 and the Canadian National Railroad, CNRR, is beneficial to the safety and welfare of the State of Illinois and the county as a whole; and

 

WHEREAS, federal funds totaling $226,135, and requiring a 20 percent local share of the total cost, were granted to Lake County in 2008 for the improvement of Butterfield Road at IL Rte 60 and the CNRR; and

 

WHEREAS, said federal funds will lapse after September 30, 2011, if not authorized and/or if not obligated by contract by September 30, 2012; and

 

WHEREAS, the State of Illinois and Lake County believe it would be beneficial to the safety and welfare of the motoring public if Butterfield Road at IL Rte 60 and the CNRR could be improved; and

 

WHEREAS, the State of Illinois and Lake County are desirous of entering into an agreement to utilize federal highway funds for the improvement of Butterfield Road at IL Rte 60 and the CNRR setting forth the terms and obligations to each agency, a draft copy of which is attached hereto; and

 

WHEREAS, this agreement will obligate the funds and give the County up to one year to initiate the improvement of Butterfield Road at IL Rte 60 and the CNRR; and

 

WHEREAS, the near term improvement of Butterfield Road at IL Rte 60 and the CNRR may not be as pressing now that the CNRR has re-routed train movements on the CNRR to the EJ&R RR just north of this intersection; and

 

WHEREAS, this agreement provides the County the opportunity to have the said $226,135 in federal funds administratively re-programmed to another project and obligated by contract by September 30, 2012.

 

NOW, THEREFORE BE IT RESOLVED by this Lake County Board that the County Board Chair, the County Clerk and the County Engineer of Lake County are authorized and they are directed to execute an agreement and any subsequent amendments thereto, for the improvement of Butterfield Road at IL Rte 60 and the CNRR designated as Section 04-00137-00-RR.

 

BE IT FURTHER RESOLVED that the County Engineer shall transmit in writing the final agreement, and any amendments, to be executed by the County Board Chair and the County Clerk.

 

BE IT FURTHER RESOLVED, that the County Engineer submit whatever documentation is required by IDOT to obligate the funds and for reimbursement to the Lake County Division of Transportation for expenditures made to provide engineering for the improvement at Butterfield Road at IL Rte 60 and the CNRR designated as Section 04-00137-00-RR.

 

BE IT FURTHER RESOLVED that this agreement, when executed in its final form, be submitted to the Illinois Department of Transportation for their approval and final processing.

 

BE IT FURTHER RESOLVED that the County Engineer be authorized to pursue the administrative re-programming of these federal funds to another project so as to obligate them by contract as required by dates set by the Illinois Department of Transportation in concert with the Federal Highway Administration.
