Joint resolution authorizing the Lake County State’s Attorney and Planning, Building and Development (PBD) Department to commence the necessary actions to demolish certain properties containing dangerous and unsafe structures.

 

Staff Summary

                     Pursuant to state law, the County Board has authority to demolish any dangerous and unsafe structures within unincorporated portions of Lake County.

                     PBD has identified, in the resolution, five dangerous and unsafe structures within unincorporated portions of Lake County.

                     Once approved, the Lake County State’s Attorney will begin to issue notices to property owners to repair or demolish the identified structures, as well as make application to the Circuit Court seeking authorization to demolish if property owners are nonresponsive.

                     If authorized by the Circuit Court, PBD will initiate the demolition of the dangerous and unsafe structures.

 

Body

WHEREAS, pursuant to 55 ILCS 5/5-1121, the County Board was given and has authority to demolish, repair, or cause the demolition or repair of dangerous and unsafe or uncompleted and abandoned buildings within the territory of the county outside any city, village or incorporated town upon application to the Circuit Court for an order authorizing such action.

 

NOW, THEREFORE, BE IT RESOLVED by the County Board of the County of Lake that:

The structures on the following described premises are dangerous and unsafe or uncompleted and abandoned and constitute an actual danger to the public health, safety and welfare:

EAB 117-09                     Section 16, Township 43 North, Range 10, PIN 14-16-100-075, commonly known as 23894 N. Midlothian Road, Lake Zurich, IL (a fire-damaged, unsafe residential structure).

 

CDH 135-10                     Section 12, Township 46 North, Range 9, PIN 01-12-100-002; commonly known as 42760 N. Linden Lane, Antioch, IL (unsafe, dilapidated residential structure, detached garage and boat house).

 

EAB 225-10                     Section 14 and 23, Township 45 North, Range 9, PIN 05-14-325-005; commonly; known as 35089 N. Rosewood Avenue, Ingleside, IL (unsafe, fire-damaged residential structure).

 

RPS  20-10                     Section 17, Township 43 North, Range 10, PIN 14-17-202-035; commonly known as 23780 N. South Lakewood Lane, Lake Zurich, IL (unsafe, vacant, dilapidated residential structure).

 

GT    70-10                     Sections 24 and 25, Township 43 North, Range 9, PIN 13-25-200-001 and 13-24-400-017; commonly known as 25406 W. Scott Road, Barrington, IL (unsafe, fire-damaged residential structure).

 

That the above described premises are situated within Lake County, State of Illinois, and are not within the corporate limits of any city, village or incorporated area, and

 

The County Board hereby authorized and requests the Lake County State’s Attorney to immediately issue notice to all parties necessary, said notice and said parties as are prescribed by 55 ILCS 5/5-1121, to commence proceedings to put the structure(s) on the above described premises in a safe condition or to demolish the same, and

 

The County Board does hereby authorized and request the Lake County State’s Attorney to make application to the Circuit Court, pursuant to 55 ILCS 5/5-1121, to demolish or cause the demolition of the structures on the above described premises where after fifteen days written notice by mail, and where appropriate, by posting, those parties notified in accordance with the above mentioned statutory section have failed to commence proceedings to put such structure(s) in a safe condition or to demolish the same.  Following the Lake County State’s Attorney’s application to the Circuit Court and upon the entry in the Circuit Court of an order authorizing the demolition of the structures on the above described premises, the Lake County Planning, Building and Development Department is hereby authorized to initiate the process to demolish said structures.
