Ordinance implementing the authority permitted pursuant to Illinois Public Act 097-0084 to require any County Board appointed board or commission to provide various information, including financial documents, to the County Board.
 
Staff Summary
·      Illinois Public Act 097-0084 authorizes a county board in a county with a population between 300,000 and 2,000,000 residents to, by ordinance, require any board or commission for which the county board chairman nominates and the county board confirms member appointments to provide the county with certain information.
·      The County Board Chairman appoints and the County Board confirms appointments to over 90 boards or commissions.
·      If approved, the ordinance will require the boards and commissions to provide several important documents, including: a budget document for the current year; the most recently completed audited financial statements; and any required legal filings with State or regulatory agencies, to name a few.
·      The ordinance will also require immediate disclosure to the County of any internal finding of non-compliance with any federal or State regulation or any allegation of criminal activity involving the board or commission, including allegations related to agents, officers, employees, or any other person performing work on behalf of said board or commission.
 
Body
WHEREAS, the County Board Chairman has the legal duty to appoint individuals to serve on the governing bodies (such as boards and commissions) of various units of local government and agencies throughout Lake County, and the individuals appointed must be confirmed by the County Board; and
 
WHEREAS, the County Board Chairman and the County Board want to ensure that these units of local government and agencies continue to serve Lake County residents in an open, transparent and fiscally responsible manner; and
 
WHEREAS, Illinois Public Act 097-0084 (55 ILCS 5/5-1133) authorizes a county board in a county with a population between 300,000 and 2,000,000 residents to, by ordinance, require any unit of local government or agency for which the county board chairman nominates and the county board confirms appointments to provide the county with certain information; and
 
WHEREAS, pursuant to the 2010 Census, the population of Lake County is 703,462; and
 
WHEREAS, the County Board Chairman and the County Board find that it is in the best interest of the citizens of Lake County to implement the authority permitted pursuant to Illinois Public Act 097-0084.
 
NOW, THEREFORE, BE IT ORDAINED, by this County Board of Lake County, Illinois that:
 
1.      All units of local government and agencies for which appointments are made by the County Board Chairman and County Board shall, at a minimum, provide:
a.      an organizational chart;
b.      a budget document for the current year;
c.      the most recently completed audited financial statements, including internal control and management letters;
d.      any required legal filings with State or regulatory agencies;
e.      the most recent version of all reports submitted to the governing body of the unit of local government or agency;
f.      the bylaws of the unit of local government or agency;
g.      employment policies, including but not limited to personnel contracts; and
h.      proof of insurance bonds for all office-holders (if required).
 
2.      The aforementioned information shall be provided to the County Board Chairman's office no later than January 1st on an annual basis, or within 14 business days upon written request by the County Board Chairman.
 
3.      All units of local government or agencies for which a majority of member appointments are made by the County Board Chairman and County Board shall, upon discovery, immediately disclose to the County Board Chairman's office any internal finding of non-compliance with any federal or State regulation or any allegation of criminal activity involving the unit of local government or agency, including allegations related to agents, officers, employees, or any other person performing work on behalf of the unit of local government or agency.      
 
BE IT FURTHER ORDAINED, that absent any policy listed above, an agency may be required to adopt as a minimum standard the County's policy where applicable and appropriate; and
 
BE IT FURTHER ORDAINED, that this ordinance shall be filed with the County Clerk.
