Staff Summary
· In 2010 the County and the Solid Waste Agency of Lake County entered into a new intergovernmental agreement regarding the collection of the Affected Area Compensation Fee and the local surcharge fee related to landfills in Lake County, and that agreement set forth the new terms for distribution of the fees collected.
· Subsequent to that agreement the Board approved a transfer of $1,866,221 of the $2,966,221.64 balance in the Solid Waste Management Tax fund as of November 30, 2009, leaving a balance of $1,100,000.64 in the fund.
· The County Administrator’s Office and Health Department now wish to enter into an agreement regarding the cooperative future use of the remaining fund balance.
Body

WHEREAS, in 2010 the County and the Solid Waste Agency of Lake County entered into a new intergovernmental agreement regarding the collection of the Affected Area Compensation Fee and the local surcharge fee related to landfills in Lake County. That agreement set forth the new terms for distribution of the fees collected, and;

WHEREAS, Subsequent to that agreement the Board approved a transfer of $1,866,221 of the $2,966,221.64 balance in the Solid Waste Management Tax fund as of November 30, 2009, leaving a balance of $1,100,000.64 in the fund. That transfer has been made, and;

WHEREAS, The CAO and Health Department now wish to enter into an agreement planning for a cooperative use of the remaining fund balance in the future.

WHEREAS, The CAO and Health Department recognize and agree that this fund is to be used for costs associated with inspection, monitoring and enforcement costs borne by the Health Department, and;

WHEREAS, The CAO and Health Department agree that funding will be released for these purposes only by mutual agreement of the use and amounts by the CAO and Health Department as part of the annual budgeting reques...
