Ratification of Proposed Revisions to Lake County Health Department Food Program Administrative Procedures and Policies (as authorized in Lake County Code of Ordinances Chapter 173) - Mackey

 

Body

Environmental Health is proposing revisions to the Food Program Administrative Procedures and Policies to provide additional guidance and clarity for the implementation of temporary food service permits. Other additions contain guidance on the issuance of citations (ordinance violation tickets), food trucks, cottage foods, reclassifying risk categories, food smokers, and payment plans and refunds for food service facility permits. Additional revisions provide consistency and clarity in terminology or language.

 

Specifically, the significant proposed revisions are as follows:

 

                     Section IV.e specifies the process for the issuance of citations (ordinance violation tickets) and provides examples of situations that would warrant it.

                     Section VI.a describes and defines public and private events and specifies when a temporary food service event permit is required.

                     Section VI.c describes the acceptable food sources for a temporary food service event, requires that a commissary is used as a base of operations for temporary food service events, and describes the conditions for use.

                     Section VI.e describes and defines a food truck and contains provisions for commissary use for operations using food trucks.

                     Section VI.h adds guidance on cottage foods, specifying that they are exempt from permit requirements if they are properly registered and operated.

                     Section VI.i describes terms under which inspections of temporary food service events may be waived, and the process to be followed.

                     Section VI.k adds repeatedly operating without a proper temporary food service event permit or repeated arriving more than one hour late to events as conditions that may warrant an office hearing.

                     Section VII.c describes food smoker usage and location in a permanent food facility.

                     Section VII.e adds terms to allow payment plans for payment of annual permanent food permits.

                     Section VII.f adds criteria and terms for issuance of refunds of the annual permanent food permits.

 

These revisions were approved by the Board of Health Environmental Health Advisory Committee on August 15, 2022.
