Joint resolution authorizing the execution of Second Amendment to the 2014 Amended and Restated Agreement for Retail Sanitary Sewer Service between Lake County and the Village of Kildeer.

 

Staff Summary

                     The County and the Village entered into an Intergovernmental Agreement on October 14, 2014, to provide retail sanitary sewer to portions of the Village of Kildeer.

                     The Village now seeks to expand the Retail Agreement’s service area to a property which is currently outside of the existing service area but was recently annexed by the Village and is adjacent to an existing property within the service area.

                     The Village has permitted the construction of a Thornton’s Gas Station on the property at Plum Grove Road and Rand Road (Illinois Route 12)

                     The County has determined that the extension of retail sanitary sewage service to the new property is feasible.

                     The Amendment to the Agreement was approved by the Kildeer Village Board on April 19, 2022.

                     This resolution authorizes the execution of a Second Amendment to the 2014 Amended and Restated Agreement for Retail Sanitary Sewer Service.

                     In accordance with County Board Rules, the State’s Attorney’s Office has reviewed this Intergovernmental Agreement prior to action by the County Board.

R E S O L U T I O N

 

WHEREAS, the County of Lake (the “County”) has entered into an Agreement for Retail Sanitary Sewer Service (the “Agreement”) with the Village of Kildeer (“Village”) dated October 14, 2014; and

 

WHEREAS, on October 16, 2018, the County and the Village entered into a First Amendment to the Agreement for Retail Sanitary Sewer Service (the “First Amendment”) (the Agreement and First Amendment shall hereinafter be referred to collectively as the “Retail Sewage Agreement”); and

 

WHEREAS, the Village desires to expand the service area for purposes of providing retail sanitary sewer to property located at Plum Grove Road and Rand Road (Illinois Route 12), which is currently outside of the existing service area but annexed by the Village and is adjacent to an existing property within the service area; and

 

WHEREAS, the County's system has sufficient capacity to provide service to the area as requested by the Village; and

 

WHEREAS, execution of a Second Amendment to the Retail Sewage Agreement must be authorized by Resolution of the County Board.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Chair of the Board and the County Clerk be and are hereby authorized and directed to execute and attest the attached Second Amendment with the Village in substantially the form substantially herein.
