Title

Ordinance requesting the granting of temporary and permanent easements and authorizing an easement agreement with the Lake County Forest Preserve District for the Ela Road at Long Grove Road intersection improvements.

 

Staff Summary

                     The proposed intersection improvement for Ela Road at Long Grove Road involves the installation of a new traffic signal, addition of turn lanes, and non-motorized improvements.

                     The County needs both temporary and permanent easements from the Lake County Forest Preserve District to construct and maintain these improvements.

                     As consideration for granting the easements, the District desires certain improvements be included as part of the project, including the removal of invasive species, installation of vegetated swales, and improved connectivity to the Cuba Marsh Forest Preserve trail network.   

                     This improvement is included in the Transportation Improvement Program with construction planned to begin in 2022, contingent upon land acquisition and permit approvals, and designated as Section 14-00144-20-CH.

O R D I N A N C E

 

ORDINANCE FINDING IT NECESSARY OR CONVENIENT FOR LAKE COUNTY TO USE REAL ESTATE OWNED BY THE LAKE COUNTY FOREST PRESERVE IN CONNECTION WITH THE IMPROVEMENT OF ELA ROAD AT LONG GROVE ROAD

 

WHEREAS, Ela Road, County Highway 60, and Long Grove Road, County Highway 43, are designated routes on the County highway system; and

 

WHEREAS, to ensure the free flow of traffic and the safety and welfare of the traveling public, Lake County (County) and the Lake County Forest Preserve District (District) believe it would be beneficial to improve the intersection of Ela Road and Long Grove Road with the installation of a new traffic signal, addition of turn lanes, and non-motorized improvements; and

WHEREAS, this improvement requires the District to grant temporary and permanent easements to allow the County to construct and maintain the improvements; and

 

WHEREAS, pursuant to Section 10 of Article 7 of the Illinois Constitution of 1970, units of local government, such as the County and the District, may contract or otherwise associate among themselves in any manner not prohibited by law or ordinance; and

 

WHEREAS, in accordance with the Local Government Property Transfer Act, 50 ILCS 605/0.01, et seq., it is necessary or convenient for the County to use, occupy, or improve the real estate, as depicted in the draft easement agreement attached hereto, held by the District, in the making of any public improvement or for any public purpose; and

 

WHEREAS, in accordance with the Local Government Property Transfer Act, 50 ILCS 605/0.01, et seq., the District may grant or convey such real estate to the County upon such terms as may be agreed upon by the corporate authorities of the County and the District and subject to the provisions of such Act; and

 

WHEREAS, the District desires that the County include, as part of the improvement, the removal of invasive species on District property and within the project limits, the installation of vegetative swales to divert and clean storm water, and improved connectivity to the Cuba Marsh Forest Preserve trail network; and

 

WHEREAS, Lake County and the District are desirous of entering into an easement agreement stating the terms and conditions for the granting of temporary and permanent easements necessary to build and maintain the intersection improvements, a draft copy of the easement agreement is attached hereto.

 

NOW, THEREFORE BE IT ORDAINED by this Lake County Board, that the County Board Chair, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized, and are hereby directed to enter into an agreement and any amendments, between Lake County and the District stating the terms and conditions for the granting of temporary and permanent easements necessary to construct and maintain the intersection improvements at Ela Road at Long Grove Road, designated as Section 14-00144-20-CH.

 

BE IT FURTHER ORDAINED that the County Engineer shall transmit, in writing, the final agreements and any amendments to be executed by the County Board Chair and the County Clerk.

 

BE IT FURTHER ORDAINED by this Lake County Board as follows:

 

Section 1: Recitals: The recitals set forth above are incorporated as part of this Ordinance by this reference.

 

Section 2: Declaration of Necessity: The County Board hereby finds and declares that it is necessary, or convenient, for the County to use, occupy, or improve the real estate, held by the District, as depicted and described in the draft easement agreement, attached hereto, in the making of a public improvement or for a public purpose.

 

Section 3: Granting of the Easements: The County Engineer is hereby authorized to execute whatever documents are necessary to accept and effectuate the granting of the above-described easements from the District to Lake County in accordance with this Ordinance. The County Engineer shall prepare, or have prepared, the documents necessary for granting of the easements.

 

Section 4: This Ordinance shall be in full force and effect from, and after, its passage and adoption by the County Board.
