RESOLUTION
WHEREAS, the County Board shall provide the compensation of Clerks of the Circuit Court according to 705 ILCS 105/27.3; and
WHEREAS, on May 12, 2020, the County Board set the compensation for County-wide elected officers prior to the term for which that officer is elected pursuant to 50 ILCS 145/2; and
WHEREAS, said May 12, 2020 Resolution included the setting of the Clerk of the Circuit Court’s compensation for the years 2021, 2022, 2023 and 2024; and
WHEREAS, 50 ILCS 145/2 requires that the County Board set the compensation for elected officials of units of local government not less than six months before those officials take office; and
WHEREAS, according to Article VII, Section 9(b) of the Illinois Constitution, an increase or decrease in the salary of an elected officer of any unit of local government shall not take effect during the term for which that officer is elected; and
WHEREAS, according to Article VI, Section 18(b) of the Illinois Constitution, the Clerk of the Circuit Court is an elected official who is a non-judicial officer of the judicial branch of state government not an elected officer of a unit of local government subject to Article VII, Section 9(b) or 50 ILCS 145/2; and
WHEREAS, the Clerk of the Circuit Court therefore has no restrictions on timing of or changes to salary or other benefits during the term of office subject to 50 ILCS 145/2 or Article VII, Section 9(b); and
WHEREAS, said May 12, 2020 Resolution should be amended to remove the Clerk of the Circuit Court and compensation approved by means of that resolution; and
WHEREAS, the County Board has determined to maintain the Clerk of the Circuit Court’s compensation consistent with the compensation originally established in the May 12, 2020 Resolution.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the annual salary for the Clerk of the Circuit Court shall be as follows for the years indicated:
For the year December 1, 2020 - November 30, 2021: $127,874;
For the year December 1, 2021 - November 30, 2022: $127,874;
For the year December 1, 2022 - November 30, 2023: $127,874;
For the year December 1, 2023 - November 30, 2024: $127,874; and
BE IT FURTHER RESOLVED, that the May 12, 2020 Resolution is hereby amended thereby removing the Clerk of the Circuit Court and any compensation approved by means of that resolution.
BE IT FURTHER RESOLVED, that this Resolution shall be in full force and effect immediately upon its adoption.
