Joint resolution approving the Second Amendment to Program Year (PY) 2021 the U.S. Department of Housing and Urban Development (HUD) Annual Action Plan (AAP).
Staff Summary
• HUD requires the submission of an AAP and associated amendments to govern expenditure of federal housing and community development funding for each program year.
• The second amendment to the PY 2021, approved by the Lake County Housing and Community Development Commission (HCDC) on August 25, proposes the following changes:
o Supplemental funding for previously approved projects including a senior housing construction, affordable housing rehab and resale, a community integrated living arrangement and down payment assistance.
o Reallocation of prior program year funding to support the acquisition and rehabilitation of scattered site properties from the Lake County Housing Authority (LCHA).
o Change in subrecipient from Lake County Administrator’s Office to the Independence Center for facility improvements at the Living Room Wellness Center.
• Contingency fund approvals will be subject to specific administrative approval mechanisms and Board Committee reporting requirements for contract contingencies.

RESOLUTION
WHEREAS, HUD requires the submission of an Annual Action Plan (AAP) to govern the expenditure of federal entitlement funding; and
WHEREAS, timely spending of HUD entitlement funds is evaluated for compliance on an annual basis; and
WHEREAS, the Lake County Housing Authority (LCHA) is executing a repositioning of assets that includes the disposition of single-family scattered site rental properties; and.
WHEREAS, the Lake County Housing and Community Development Commission (HCDC) approved a special affordable housing application round as a mechanism to increase spending; and
WHEREAS, applicants submitted funding requests to preserve affordable housing through the acquisition and rehabilitation of LCHA properties; and.
WHEREAS, applications were reviewed, scored and funding amounts approved by the Affordable Housing Advisory and Recommendation Committee (ARC) and the HCDC; and
WHEREAS, an amendment to the AAP is required to substantially change the purpose, budget, location, scope or beneficiaries of a project; and
WHEREAS, the second amendment to the Program Year 2021 (PY 2021) AAP includes allocations to Raquan’s Haven ($115,000), Urban Muslim Minority Alliance ($175,000), A Safe Place ($200,000), Housing Opportunity Development Corp. ($474,116), Youth Conservation Corps. ($200,000), Community Partners for Affordable Housing ($78,968) to support the acquisition and rehabilitation of LCHA properties; and
WHEREAS, a total of $100,000 of contingency funds were approved to account for necessary project cost deviations; and
WHEREAS, in accordance with the Grant Funding Allocation Policy, approved Tier 2 projects were evaluated for project readiness and capacity for timely spending; and
WHEREAS, the second amendment to the PY 2021 AAP includes supplemental (Tier 2) funding for; The Debruler Co - Mundelein Senior Housing ($124,802), Youth Conservation Corps. ($41,302) - Housing Rehabilitation and Resale, Clearbrook - Wright Home Rehabilitation ($18,330) and Community Partners for Affordable Housing (CPAH) - Down Payment Assistance Program ($50,000); and
WHEREAS, the second amendment to the PY21 AAP includes changing the subrecipient for a facility rehabilitation award from Lake County Administration to the Independence Center; and
WHEREAS, following the public hearing on August 25, 2021 the Lake County HCDC voted to approve the second amendment to the PY 2021 AAP.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that by this County Board of Lake County, Illinois, that the second amendment to the PY 2021 AAP is hereby approved and an emergency appropriation in the amount of $65,241.68 is hereby authorized in the Fiscal Year 2021 budget in the Fund 740 HUD Grants budget as detailed in the attachment; and
BE IT FURTHER RESOLVED, that the Chair of the Lake County Board or their designee is hereby authorized to execute the necessary documents to complete the submission of the PY 2021 AAP; and
BE IT FURTHER RESOLVED, that the Chair of the Lake County Board or their designee is hereby authorized to execute the initial contracts, as outlined above, to support the acquisition and rehabilitation of LCHA properties; and
BE IT FURTHER RESOLVED, that the Community Development Administrator has authority to approve contingency requests for LCHA rehabilitation less than $25,000. Requests for contingency funding $25,000 or greater shall be approved by the Lake County Administrator.
