Joint resolution authorizing an agreement with the Village of Long Grove and the Lake County Forest Preserve District for the installation of buffer plantings as part of the Buffalo Creek Wetland Mitigation Bank project.

 

Staff Summary

                     The County Board, at its meeting of August 9, 2016, appropriated $2,285,000 of County Bridge Tax funds for the construction of the Buffalo Creek Wetland Mitigation Bank.

                     The County Board, at its meeting on October 11, 2016, authorized an agreement with the Lake County Forest Preserve District (LCFPD) for construction and maintenance of the Buffalo Creek Wetland Mitigation Bank.

                     The Village of Long Grove (Village) has requested that buffer plantings be installed to mitigate removal of vegetation that was necessary for the installation of the new recreational trails.

                     As part of the agreement, the County, LCFPD, and Village would equally split the costs to provide and install the proposed buffer plantings, up to and not exceeding an amount of $90,000. 

                     This agreement was approved by the Village of Long Grove on June 8, 2021.

R E S O L U T I O N

 

WHEREAS, the County Board, at its meeting on August 9, 2016, appropriated $2,285,000 of County Bridge Tax funds for the construction of the Buffalo Creek Wetland Mitigation Bank; and

 

WHEREAS, the County Board, at its meeting on October 11, 2016, authorized an agreement with the Lake County Forest Preserve District (LCFPD) for construction and maintenance of the Buffalo Creek Wetland Mitigation Bank; and

 

WHEREAS, during construction, it was necessary to remove some of the existing vegetation and trees to accommodate the installation of new recreational trails; and 

 

WHEREAS, the Village of Long Grove (Village) has requested that buffer plantings be installed to mitigate screening that was lost due to the construction of these trails; and 

 

WHEREAS, as part of this agreement, Lake County, the LCFPD, and the Village would equally share in the cost for the buffer plantings; and

 

WHEREAS, pursuant to Section 10 of Article 7 of the Illinois Constitution of 1970, units of local government, such as the County, the LCFPD, and the Village may contract or otherwise associate among themselves in any manner not prohibited by law or ordinance; and

 

WHEREAS, Lake County, the Village, and the LCFPD are desirous of entering into an agreement stating the terms and conditions for installation of buffer plantings as part of the Buffalo Creek Wetland Mitigation Project, a draft copy of which is attached hereto.

 

NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized, and are hereby directed to enter into an agreement, and any amendments, between Lake County, the Lake County Forest Preserve District, and the Village of Long Grove stating the terms and conditions for the installation of buffer plantings as part of the Buffalo Creek Wetland Mitigation Bank project, and designated as 01-00000-00-ES.

 

BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement, and any amendments, to be executed by the County Board Chair and the County Clerk.
