Resolution amending the 2019 Lake County Solid Waste Management Plan, clarifying intent of the plan regarding which entities must have host agreements amended or extended.

 

Staff Summary

                     The County’s Waste Management Plan was adopted in 1989 as the Solid Waste Management Plan and has delegated the updating of this plan to the Solid Waste Agency of Lake County (SWALCO).

                     The plan was most recently amended in 2019, which resulted in the addition of a new section related to developing a circular economy plan and implementation.

                     After a recent review it was determined that additions were necessary to provide clarity related to Host Community Benefit Agreements.

RESOLUTION

 

WHEREAS, the Lake County Solid Waste Management Plan (the “Plan”) was adopted by the Lake County Board in September 1989; and

 

WHEREAS, the Solid Waste Agency of Lake County (SWALCO) has been authorized by Lake County to prepare required five-year plan updates and plan amendments to the Plan; and

 

WHEREAS, the Lake County Board has approved Plan updates developed and approved by SWALCO in 1994, 1999, 2004, 2009, 2014 and 2019; and

 

WHEREAS, the Lake County Board has approved Plan amendments developed and approved by SWALCO in May 2008 and May 2009; and

 

WHEREAS, SWALCO has developed and approved a third Plan amendment for consideration and adoption by the Lake County Board; and

 

WHEREAS, the Public Works, Planning and Transportation Committee has reviewed and recommends the proposed Plan amendment, as stated below.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the 2019 Solid Waste Management Plan Update be amended as follows

 

The first and second paragraph of the Host Community Benefit Agreements recommendation A.1 on page 6-4 of the 2019 Solid Waste Management Plan Update be amended as shown in underline as follows.

A.1.  Prior to filing a siting application, pursuant to Section 39.2 of the Illinois Environmental Protection Agency, for a new pollution control facility or for an expansion or significant modification to an existing pollution control facility, the applicant shall first enter into Host Community Benefit Agreements (defined as any type of legal agreement entered into or assumed by an applicant and any other person or legal entity) with the following units of local government:  1) the governing body with jurisdiction over the proposed facility, 2) SWALCO and 3) Lake County.  In addition, the applicant may enter into additional Host Community Benefit Agreements with other appropriate units of local government, as determined by the applicant.  In the event the applicant represents an existing pollution control facility with existing Host Community Benefit Agreements, the applicant shall amend each existing Host Community Benefit Agreement with each respective party prior to filing the siting application with the governing body; thus, the owner of the Zion Landfill shall be required to reach agreement on an amendment concerning any proposed landfill expansion with: City of Zion, SWALCO, Lake County and Village of Winthrop Harbor; and thus the owner of the Countryside Landfill shall be required to reach agreement on an amendment concerning any proposed landfill expansion with: Lake County, the Village of Grayslake, the Village of Round Lake Park, the Village of Hainesville and Prairie Holdings, Inc.

 

The new and/or amended Host Community Benefit Agreements, with the governing body with local siting jurisdiction, SWALCO and Lake County, must, at a minimum, contain provisions for: 1) a guarantee of access to capacity at the facility for Lake County’s unincorporated and incorporated solid waste, 2) environmental safeguards, and 3) payment of host benefit fees.
