Resolution approving Amendment Number Two to the Lake County CARES Act Funding Plan and authorizing an emergency appropriation and line item transfers of the Coronavirus Aid, Relief, and Economic Security (CARES) Act funds across approved Lake County CARES Act Categories in direct response to the COVID-19 Public Health Emergency.

 

Staff Summary

                     The CARES Act was passed by Congress and signed into law on March 27, 2020. On April 23, 2020, Lake County received $121,539,986.20.

                     On July 27, 2020 the Lake County CARES Act Funding Plan was approved by the County Board. On September 29, 2020, the County Board approved Amendment Number One to the plan. This is Amendment Number Two to the plan. 

                     To date, $119,500,000 of CARES Act funding has been appropriated and distributed in the approved Lake County CARES Act Categories.

                     Amendment Number Two includes transferring $1,500,000 from the Resident Support and Assistance Category to the Public Health Support and Assistance Category for mass vaccination requirements as well as emergency appropriating the remainder of the Lake County CARES Act funds ($2,039,986.20).

                     As previously approved:

o                     Authority to spend appropriated funds within CARES Act Categories and execute any and all agreements with partners related to the allocation and distribution of CARES Act funds is delegated to the County Administrator or their designee(s).

o                     CARES Act budget allocations may be amended with line item transfers between CARES Act Categories as approved by the County Board.

o                     Any CARES Act funds not spent or encumbered by December 15, 2020 will be reallocated to the County wide Essential Service category.

RESOLUTION

 

WHEREAS, the Coronavirus Aid, Relief, and Economic Security (CARES) Act was passed by Congress and signed into law on March 27, 2020. Lake County’s population over 500,000 resulted in the ability to directly apply for funding. On April 23, 2020, Lake County received $121,539,986.20; and

 

WHEREAS, these funds are required to be used to cover expenses that: (1) are necessary due to the public health emergency with respect to the Coronavirus Disease 2019 (COVID-19); (2) were not accounted for in Lake County’s approved Fiscal Year 2020 budget; and (3) were incurred during the period March 1, 2020 - December 30, 2020; and

 

WHEREAS, Lake County has needs for Coronavirus relief funds in its continued response to the COVID-19 public health emergency; and

 

WHEREAS, on July 27, 2020, the County Board approved the Lake County CARES Act Funding Plan and appropriated funds in accordance with the plan; and

 

WHEREAS, on September 29, 2020, the County Board approved Amendment Number One to the plan that updated guidance, programs, and the allocation of CARES Act funds to better support Lake County communities, taxing districts, and allow Lake County to maintain its county-wide services; and

 

WHEREAS, Amendment Number Two to this plan (“Amended Plan”) further updates programs and the allocation of CARES Act funds to best support Lake County communities, taxing districts, and allow Lake County to maintain its county-wide services; and

 

WHEREAS, an emergency appropriation is necessary to make the remaining CARES Act funds ($2,039,986.20) available for the purposes designated by the County Board in the Amended Plan; and

 

WHEREAS, the Amended Plan requires the total distribution of CARES Act funds in each of the approved Lake County CARES Act Categories be amended to $13,500,000 in Resident Support and Assistance, $17,000,000 in Business and Economic Assistance, $42,000,000 in Municipal and Local Essential Services, $17,200,000 in Public Health Support and Assistance, $1,750,000 in PPE Stockpile and Distribution, $28,050,000 in County-wide Essential Services, and $2,039,986.20 in Contingency / Reserve.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that Amendment Number Two of the Lake County CARES Act Funding Plan (“Amended Plan”) attached to this Resolution is approved and shall be executed by the County Administrator; and

 

BE IT FURTHER RESOLVED, that an emergency appropriation in the amount of $2,039,986.20 in the Fund 745 CARES Act Coronavirus Relief Fund budget is hereby authorized as indicated in the attached; and

 

BE IT FURTHER RESOLVED, that an expense budget for the administrative execution of the programs designated be amended as indicated in the Amended Plan attached to this Resolution; and

 

BE IT FURTHER RESOLVED, that the authority to spend funds in accordance with the Amended Plan’s distribution budget and execute any and all agreements related to the allocation and distribution of funds within a CARES Act Category is delegated to the County Administrator or their designee(s); and

 

BE IT FURTHER RESOLVED, that the County Administrator may authorize line item transfers between expense types within the same CARES Act Category because the exact nature of the expenses is unknown upon appropriation; and

 

BE IT FURTHER RESOLVED, that a line item transfer is hereby authorized, transferring funding from Resident Support and Assistance to Public Health Support and Assistance in the amount of $1,500,000 as indicated in the attached; and

 

BE IT FURTHER RESOLVED, that the County Administrator may authorize line item transfers from the Contingency/Reserve CARES Act Category into any approved CARES Act Category in the Amended Plan in order to meet expanded or emerging needs; and

 

BE IT FURTHER RESOLVED, that any CARES Act funds not spent or encumbered by December 15, 2020 will be re-allocated to the County-wide Essential Services CARES Act Category as defined in the version of the CARES Act Funding Plan in effect on that date.
