Joint resolution authorizing an agreement with the Illinois State Toll Highway Authority and the Village of Gurnee stating the terms and conditions for the replacement of the Stearns School Road bridge over the Tri-State Tollway (I-94) and appropriating $5,275,000 of ¼% Sales Tax for Transportation funds.

• The County will reimburse the Illinois Tollway for the County’s share of engineering and construction costs, estimated at $4,392,807.
• The County will continue to maintain the bridge deck and elements above the deck.
• The Village of Gurnee will reimburse the Tollway for the Village’s share of the bike path and sidewalk and will own and maintain both after construction.
• The project letting is planned for 2020 with construction in 2021.
• This improvement is included in the Highway Improvement Program and designated as Section 17-00236-03-BR.

R E S O L U T I O N
WHEREAS, Stearns School Road, County Highway 74, is a designated route on the County highway system; and
WHEREAS, the existing bridge that carries Stearns School Road over the Tri-State Tollway (I-94) is nearing the end of its useful service life and needs to be replaced; and
WHEREAS, Illinois State Toll Highway Authority (Tollway) maintains the bridge structure below the bridge deck; and
WHEREAS, the County maintains the bridge deck and elements above the deck with the exception of the bike path which is owned and maintained by the Village of Gurnee (Village); and
WHEREAS, the County and the Tollway believe it would be beneficial to the safety and welfare of the traveling public if the Stearns School Road bridge could be replaced; and
WHEREAS, the Village is desirous that the existing bike path be relocated to accommodate the improvement and new sidewalk be added to the south side of Stearns School Road from North Creek Drive to Lawson Boulevard; and
WHEREAS, the Tollway will be the lead agency on the project; and
WHEREAS, the County will reimburse the Tollway for its respective share of the engineering and construction costs, estimated to be $4,392,807; and
WHEREAS, upon completion of the improvement, the County will continue to maintain the bridge deck and elements above the deck, with the exception of the bike path and sidewalk which will be owned and maintained by the Village; and
WHEREAS, the County, Tollway, and Village are desirous of entering into an agreement stating the terms and conditions to each agency for the improvements, a draft copy attached hereto; and
WHEREAS, an appropriation of funds is required.
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk, and the County Engineer of Lake County, be authorized, and they are hereby directed to execute an agreement, and any subsequent amendments thereto, between Lake County, the Illinois State Toll Highway Authority, and the Village of Gurnee stating the terms and conditions to each agency for the replacement of the existing Stearns School Road bridge over the Tri-State Tollway (I-94), including improvements to Stearns School Road and non-motorized improvements.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement, and any subsequent amendments, to be executed by the County Board Chair and the County Clerk.
BE IT FURTHER RESOLVED, that $5,275,000 of ¼% Sales Tax for Transportation funds are hereby appropriated for these improvements and designated a Section 17-00236-03-BR.
