Joint resolution authorizing the disposal of excess property located at Grand Avenue at the Canadian Pacific Railway tracks and at 1st Street in the Village of Gurnee via a quitclaim deed and approving an intergovernmental agreement with the Village.

 

Staff Summary

                     Lake County owns two parcels of property, containing approximately 1.91 acres, along Grand Avenue at the Canadian Pacific Railway tracks and at 1st Street in Gurnee, Illinois.

                     The excess parcels were acquired in 1959 and 1960 and are not needed for current or future transportation improvements by the Lake County Division of Transportation.

                     This resolution authorizes the disposal of the parcels via a quitclaim deed to the Village and authorizes an agreement with the Village of Gurnee for the terms and conditions of the property transfer.

R E S O L U T I O N

 

WHEREAS, the Lake County Public Works and Transportation Committee adopted an Excess Property Disposal Policy at its regular meeting on March 8, 2017; and

 

WHEREAS, two excess parcels of County owned property designated as Index #1 and #25 (property pin number 07-23-200-071 & 07-24-100-014) have been identified as a priority to dispose of by quitclaim deed under the transfer of excess property to government agencies section of said policy; and

 

WHEREAS, the excess properties containing approximately 1.91 acres, are located within the Village of Gurnee municipal boundary; and

 

WHEREAS, the excess parcels, which were acquired in 1959 and 1960 and are not needed for current or future transportation improvements by the Lake County Division of Transportation, will be more appropriately utilized by the public under the stewardship of the Village; and

 

WHEREAS, pursuant to the 765 ILCS 5/16, the County Board may authorize its County Board Chair to convey real estate belonging to it; and

 

WHEREAS, the Local Government Property Transfer Act, 50 ILCS 605/0.01 et seq. authorizes units of local government to agree to transfer land between said units of local government; and

 

WHEREAS, the County and the Village are desirous of entering into an agreement to outline the terms and conditions of the excess property disposal, a draft copy of the agreement is attached hereto; and

 

WHEREAS, as part of the agreement, the County will require the Village to request approval from the County Engineer should the Village desire to lease, sell and/or change the use of said excess property in the future; and

 

WHEREAS, the County will prepare a quitclaim deed to be signed by the County Board Chair and attested by the County Clerk which will transfer ownership to the Village at no cost; and

 

WHEREAS, the Village has agreed to accept the transfer of the property and has adopted an ordinance at its March 2, 2020, meeting.

 

NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the transfer of excess properties at Grand Avenue at the Canadian Pacific Railway tracks and at 1st Street in the Village of Gurnee, is approved and that the County Board Chair, the County Clerk, and the County Engineer are hereby directed to execute an agreement, and any subsequent amendments, between Lake County and the Village stating the terms and conditions for the transfer.

 

BE IT FURTHER RESOLVED that the County Board Chair, the County Clerk, and the County Engineer on behalf of Lake County, Illinois, be authorized, and are hereby directed to execute whatever documents are necessary to effectuate such conveyance of the transfer of excess property.

 

BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement, any amendments and conveyance documents to be executed by the County Board Chair and the County Clerk.
