Ordinance amending Chapter 110, Amusement and Chapter 111, Liquor, of the Lake County Code of Ordinances.

ORDINANCE

 

WHEREAS, the State’s Attorney’s Office recommended changes to Chapter 110 Amusement Ordinance and Chapter 111 Liquor Ordinance of the Lake County Code of Ordinances; and

 

WHEREAS, Lake County shall amend Chapter 110, 110.17 Eligibility, A to state “Licenses shall be issued only to bona fide religious,  charitable, labor, business, fraternal, educational, veterans’ organizations, as defined in 110.15, or other bona fide not-for-profit organizations which operate without a profit to their members and which have been in existence continuously for a period of five years immediately before making application for a license, and which have had during that entire five-year period engaged in carrying out their objectives; or to a non-profit fundraising organization organized for the sole purpose of providing financial assistance to an identified individual or group of individuals suffering extreme financial hardships as the result of an illness, disability, accident, or disaster or to any law enforcement agencies or associations that represent law enforcement officials.”; and

 

WHEREAS, Lake County shall amend Chapter 110, 110.38 Application D,1 “infamous crime” to “forcible felony or a crime of moral turpitude”; and

 

WHEREAS, Lake County shall amend Liquor Ordinance, Chapter 111, 11.038 Ineligible Applicants, B to “Any applicant who is not a resident of the county, must have a manager on premises for at least 40 hours a week, that is a resident of the county.”

 

WHEREAS, Lake County shall amend Liquor Ordinance, Chapter 111, 111.050 Waiver of License title to “Relinquishment Upon Sale” and the language to “If a current liquor license holder proposes to sell its business and presents to the Liquor Commission a proposed contract with a non-liquor license holder, the Commissioner may accept the relinquishment of the current license and consider at a hearing the application of the proposed license holder, and in the Commissioner’s discretion, tender the seller’s current license to the buyer upon completion of the sale. Before receiving this license, the buyer must meet all requirements of the liquor license process before the relinquishment to the buyer becomes effective.”

 

NOW, THEREFORE, BE IT ORDAINED, by this County Board of Lake County, Illinois, that amendments to the Lake County Code of Ordinances, Chapters 110 and 111, as attached to this ordinance be adopted and be made effective immediately.
