Ordinance authorizing the proposed revisions to Lake County Code of Ordinances Chapter 177, Tobacco Regulations.

Staff Summary
* Due to the adoption of the Prevention of Tobacco Use by Persons under 21 Years of Age and Sale and Distribution of Tobacco Products Act (720 ILCS 675/), also known as Tobacco 21, revisions to Chapter 177 need to be made to align the ordinance with the Act.
* The amendments to the Act changed the definition of a "tobacco product" by removing electronic cigarettes and alternative tobacco products, defining each of these items separately.
* To make the correction, the proposed revisions to Chapter 177 strike the current definitions of "tobacco product" and "electronic smoking device," and add the definitions of "tobacco product," "electronic cigarette," and "alternative nicotine product" as defined in the Act.
* Additionally, the term "tobacco products" is replaced with "tobacco products, electronic cigarettes, and (or) alternative nicotine products" throughout the ordinance.
* The Board of Health met regarding this item on February 26, 2020.

ORDINANCE
WHEREAS, the Lake County Board adopted the Lake County Tobacco Ordinance on November 14, 2000; and

WHEREAS, the Lake County Board incorporated the Lake County Tobacco Ordinance into the Lake County Code of Ordinances at Chapter 177 on February 10, 2015; and

WHEREAS, the Lake County Health Department is authorized to enforce specific sections of this Chapter; and

WHEREAS, the Lake County Health Department is proposing amendments to this Chapter that would align definitions in the Chapter with the definitions in current Illinois law; and

WHEREAS, the Lake County Board of Health has approved the proposed amendments to Chapter 177 on February 26, 2020; and

WHEREAS, the Lake County Board of Health has recommended that the proposed amendments to Chapter 177 be referred to the County Board for approval.
