Resolution authorizing the approval of the 2020 update to the 2014 Analysis of Impediments (AI) to Fair Housing Choice for program years 2020 - 2024, as required by the United States Department of Housing and Urban Development (HUD).
Staff Summary
* Federal regulations (24 CFR Part 91) require HUD-funded local governments to submit a certification that it is affirmatively furthering fair housing, which means that it will:
o conduct an analysis of impediments to fair housing choice;
o take appropriate actions to address the effects of impediments identified through that analysis; and
o maintain records reflecting the analysis and actions.
* Since the approval by Lake County Board on October 14, 2014 of an AI to Fair Housing Choice, the executive branch of the federal government changed AI documentation requirements substantially, first expanding the requirements and proscribing format via an online tool to create a new Assessment of Fair Housing (AFH). Recent executive orders, however, rescinded the AFH requirements and the online tool - leaving no clear requirements in place.
* With demographics largely unchanged and many actions still to implement from the 2014 AI, Lake County has opted to create a 2020 Update to the 2014 AI. The 2020 Update is recommended by staff as an opportunity to rearticulate impediments identified in the 2014 AI and to refresh commitments to actions intended to overcome those impediments.
* Public Hearings on the 2020 Update to the 2014 AI were held at the Housing and Community Development Commission meetings on April 10, 2019; May 15, 2019; January 15, 2020 and February 12, 2020. Comments obtained during those meetings and the 30-day public comment period are included in Appendix F of the 2020 Update.
* The Housing and Community Development Commission voted on February 12, 2020 to recommend acceptance by the County Board of the 2020 update to the 2014 AI to Fair Housing Choice.
