Proposed Revisions to Lake County Code of Ordinances Chapter 177, Tobacco Regulations - Mackey

 

Body

Due to the adoption of the Prevention of Tobacco Use by Persons under 21 Years of Age and Sale and Distribution of Tobacco Products Act (720 ILCS 675/), also known as Tobacco 21, revisions to Chapter 177 need to be made to align the ordinance with the Act. The amendments to the Act changed the definition of a tobacco product by removing electronic cigarettes and alternative tobacco products, defining each of these items separately. In Chapter 177, however, the three types of tobacco products are all currently still included in the definition of a “tobacco product.”

 

To eliminate conflict with the law, the proposed revisions to Chapter 177 strike the current definitions of “tobacco product” and “electronic smoking device,” and add the definitions of “tobacco product,” “electronic cigarette,” and “alternative nicotine product” as defined in the Act. Additionally, the term “tobacco products” is replaced with “tobacco products, electronic cigarettes, and (or) alternative nicotine products” throughout the ordinance.

 

These proposed revisions to Chapter 177 were reviewed and approved by the Environmental Health Advisory Committee at their November 18, 2019 meeting. A public hearing was held on January 27, 2020 to receive comments on the proposed changes, and none were received.
