Staff Summary
• Lake County and the Village of Libertyville entered into an agreement dated July 9, 1991, for maintenance of a portion of the North Shore Bike Path.
• Lake County and the Village of Libertyville are desirous of entering into a new updated agreement which more clearly defines maintenance responsibilities and limits of maintenance for a portion of said North Shore Bike Path.
• The Village will continue to be responsible for routine maintenance such as mowing and pothole patching.
• Lake County will continue to be responsible for capital maintenance such as pavement rehabilitation and repairs to the drainage system.
• The Village of Libertyville Board of Trustees will approve this agreement at a future board meeting.

R E S O L U T I O N
WHEREAS, the right-of-way of the former Chicago, North Shore and Milwaukee Railroad adjacent to or in proximity of Illinois Route 176 and extending from Brice Avenue within the Village of Mundelein easterly to Blodgett Avenue and Sheridan Road within the Village of Lake Bluff is owned by the State of Illinois; and
WHEREAS, Lake County may utilize said right-of-way for a bikeway pursuant to an agreement with the State dated January 21, 1991, and may enter into agreements with units of local government for maintenance of the bikeway; and
WHEREAS, Lake County constructed a bikeway within the right-of-way of the former Chicago, North Shore and Milwaukee Railroad pursuant to said January 21, 1991, agreement with the State, and said bikeway is known as the North Shore Bike Path; and
WHEREAS, Lake County and the Village of Libertyville entered into an agreement dated July 9, 1991, for maintenance of a portion of the North Shore Bike Path; and
WHEREAS, Lake County and the Village of Libertyville are desirous of entering into a new agreement which states the terms and conditions and more clearly defines maintenance responsibilities and limits of maintenance for a portion of said North Shore Bike Path, a draft copy of which is attached hereto; and
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk, and the County Engineer be authorized, and they are hereby directed to execute an agreement with the Village of Libertyville pertaining to the maintenance of the North Shore Bike Path.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement, and any subsequent amendments, to be executed by the County Board Chair and the County Clerk.
BE IT FURTHER RESOLVED that the County Engineer of Lake County is hereby authorized to include within the above-said maintenance agreement between Lake County and the Village of Libertyville, any additional locations to be maintained along the North Shore Bike Path as may be warranted from time-to-time, in accordance with said maintenance agreement.
BE IT FURTHER RESOLVED that the above-said maintenance agreement takes the place of and supersedes all prior agreements between the Village of Libertyville and Lake County related to the maintenance of the North Shore Bike Path.
BE IT FURTHER RESOLVED that a copy of the final executed maintenance agreement between Lake County and the Village of Libertyville and a copy of this resolution be sent to the Illinois Department of Transportation.
