Title

Proposed Lake County Ordinance to Restrict Groundwater Use as a Potable Source Near the Hoffelder Closed Landfill Site - Mackey

Body

Environmental Health is proposing an ordinance that would apply to specific properties on Milwaukee Avenue south of Deerfield Road in unincorporated Lake County. The proposed ordinance would not allow current or future use of groundwater as a potable (drinking water) supply on the specified parcels, two of which contain a closed landfill, and others that are across Milwaukee Avenue to the west. Adopting the ordinance would allow future development of these properties without further remediation to address the fact that the groundwater does not meet certain Class I standards established by the Environmental Protection Agency.

There are no current users of potable groundwater on these properties and the proposed ordinance, along with the existing Well Ordinance (Lake County Board of Health Ordinances Chapter 170), would not allow a new potable water well to be constructed on these properties.

A public hearing was held on July 9, 2019 to receive comments on the proposed changes and no public comments were received.

Suggested Motion

To approve the proposed ordinance.
