Ordinance approving the replacement, in its entirety, of the Lake County Highway Access Regulation Ordinance, Chapter 90, and the Lake County Temporary Highway Closure and Utility and Facility Placement Ordinance, Chapter 91, with the Lake County Highway Access and Use Ordinance along with a companion Technical Reference Manual.
Staff Summary
• The Lake County Highway Access Regulation Ordinance and the Lake County Temporary Highway Closure and Utility and Facility Placement Ordinance will be replaced with the Lake County Highway Access and Use Ordinance.
• A Technical Reference Manual will be a companion to the new Ordinance with standards, procedures, and examples to aid in the completion of the various permit processes.
• The Technical Reference Manual will be updated on a more frequent basis as standards and procedures change.
• Once approved, Chapters 90 and 91 in the Lake County Illinois Code of Ordinances will be combined to become Chapter 90.

ORDINANCE
WHEREAS, Chapter 90 of the Lake County Illinois Code of Ordinances, along with a County Board Resolution dated April 12, 1988, adopted an Ordinance dealing with Highway Access Regulation; and
WHEREAS, Chapter 91 of the Lake County Illinois Code of Ordinances, along with a County Board Resolution dated November 20, 1990, adopted an Ordinance dealing with the placement of utility and facility placement within a County highway right-of-way and
WHEREAS, this County Board may from time-to-time amend the rules, regulations, and specifications imposed by the said Ordinances in order to promote the public health, safety, comfort, and general welfare; and
WHEREAS, the Illinois Highway Code (605 ILCS 5/5-413) of the Illinois Compiled Statutes provides for access to roads and driveways for public and private use to be allowed onto a County highway only upon the issuance of a permit by the County Engineer; and
WHEREAS, the Illinois Highway Code (605 ILCS 5/5-414) of the Illinois Compiled Statutes provides for temporary closures of a County highway only upon the issuance of a permit by the County Engineer; and
WHEREAS, the Illinois Highway Code (605 ILCS 5/9-113) of the Illinois Compiled Statutes provides for the placement, removal and adjustment of utilities and facilities within the County highway right-of-way, only upon the issuance of a permit by the County Engineer, and allowed the establishment of the Coordination Council to communicate with the public utility companies; and
WHEREAS, the Illinois Highway Code (605 ILCS 5/9-115.1) of the Illinois Compiled Statutes provides for the placement of detention or retention facilities for water in relation to the public highway right-of-way, only upon the written permission by the highway authority; and
WHEREAS, the County Engineer has proposed combining the two referenced Ordinances into one Ordinance to be known as the Lake County Highway Access and Use Ordinance and establish a companion document to be known as the Lake County Highway Access and Use Ordinance Technical Reference Manual; and
WHEREAS, the Public Works, Planning and Transportation Committee has reviewed said proposed Ordinance and Technical Reference Manual and have found said documents to promote the public health, safety, comfort, and general welfare.
NOW, THEREFORE BE IT ORDAINED by this Lake County Board, that Chapters 90 and 91 of the Lake County Code of Ordinances will be combined and replaced with the Lake County Highway Access and Use Ordinance as Chapter 90, as attached hereto.
BE IT FURTHER ORDAINED that this Ordinance shall be effective on July 9, 2019.
BE IT FURTHER ORDAINED that the County Engineer will publish a codified version of the Lake County Highway Access and Use Ordinance, as provided by said ordinance.
