Proposed Revisions to Lake County Code Chapter 171, Onsite Wastewater Treatment Systems (OWTS) - Kritz

Revisions are proposed to multiple sections of the ordinance that apply to issuing permits where a public sewer system is available.

                     The definition of a “public sewer” was added. That definition specifies that the sewer is “owned and/or operated by a governmental body or public utility.”

                     Revisions are proposed to clarify the language in Section 171.035 (f), which contains requirements regarding public sewer availability. Also, in that section, the “reasonable distance” requirement to a public sewer is proposed to be changed from 250 feet to 300 feet, at the direction of the Illinois Department of Public Health in order to conform with the State Code.

                     Section 171.258, regarding variances, is proposed to be amended to reflect the new definition of public sewer.

 

Other proposed revisions are:

                     In Section 171.068 (B)(2), which contains provisions for proposals to replace a building in the same footprint and use the existing OWTS, the requirement for a licensed contractor to evaluate and prepare a report on the construction and operational status of the existing system, and the potential effect that the building project may have on the system is added. This requirement is proposed in order to provide better assurance that the existing OWTS will function properly for the new structure.

                     Section 171.126 (H)(7) was amended to correct an error in the distance requirement for surface waters or wetlands to be indicated on a proposed plan (amends to 25 feet of the subject property, not 50 feet).

                     Section 171.216 (L)(2), which required an inset geographical sketch of a property location on a proposed plan, was stricken as modern geographic information systems make that requirement unnecessary.

                     Table B.2 in Appendix B was amended for clarity in determining the most limiting soil loading rate.

                     Table B.3 was amended to correct a typographical error.

                     The Minimum Setback Distance table in Appendix D was amended to change the setback distances required between OWTS components and patios, sidewalks, and retaining walls to be the same as those required for driveways.

 

These proposed revisions to Chapter 171 were reviewed and approved by the Environmental Health Advisory Committee at their February 18, 2019 meeting. A public hearing was held on March 19, 2019 to receive comments on the proposed changes, and none were received.
