Joint resolution authorizing two agreements with the Union Pacific Railroad (UPRR) for improvements to the UPRR facilities and right-of-way necessary to accommodate the intersection improvements of Hart Road at United States (US) Route 14, and appropriating $1,011,000 of ¼% Sales Tax for Transportation funds.

 

Staff Summary

                     Hart Road at US Route 14 will be improved by widening and reconstruction.

                     The improvement will provide additional lanes at the intersection, include multi-use path and sidewalk facilities, and replace the existing traffic signals.

                     These improvements will require the UPRR to widen the existing railroad crossing and install new roadway and pedestrian signals and gates.

                     Lake County will reimburse the UPRR for this work.

                     The construction cost for this work is estimated to be $842,000.

                     The County may be eligible to receive up to 80 percent federal reimbursement for this cost.

                     This resolution authorizes two agreements with the UPRR.

                     This improvement is included in the Highway Improvement Program, with construction planned to begin in late 2019/early 2020, and designated as Section 09-00174-05-CH.

R E S O L U T I O N

 

WHEREAS, Hart Road, County Highway 53, is a designated route on the County highway system; and

 

WHEREAS, to ensure the free flow of traffic and the safety and welfare of the traveling public, Lake County is desirous of improving the intersection of Hart Road at US Route 14, by widening and reconstruction, inclusive of non-motorized improvements and designated as Section 09-00174-05-CH; and

 

WHEREAS, the UPRR owns and operates railroad facilities located within UPRR right-of-way and within the limits of the Hart Road at US Route 14 intersection improvements; and

 

WHEREAS, it will be necessary for Lake County and its contractor to access the UPRR right-of-way to construct the intersection improvements; and

 

WHEREAS, the intersection improvements will also require the UPRR to widen the existing railroad crossing and install new roadway and pedestrian signals and gates; and

 

WHEREAS, Lake County will reimburse the UPRR for this work, estimated to be $842,000; and

 

WHEREAS, Lake County may be eligible to receive up to 80 percent federal reimbursement for this cost; and

 

WHEREAS, Lake County and the UPRR are desirous of entering into two agreements stating the terms and conditions for the intersection and railroad improvements, a draft copy of which is attached hereto.

 

NOW, THEREFORE BE IT RESOLVED that the County Board Chair, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized and they are hereby directed to execute two agreements and any subsequent amendments, between Lake County and the UPRR, stating the terms and conditions for intersection improvements of Hart Road at US Route 14 and widening of the existing railroad crossing with new signals and gates.

 

BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreements and any amendments to be executed by the County Board Chair and the County Clerk.

 

BE IT FURTHER RESOLVED that there is appropriated $1,011,000 of ¼% Sales Tax for Transportation funds, and designated as Section 09-00174-05-CH.
