Resolution initiating and authorizing the submission of an advisory public question regarding a ban on the creation of a statewide property tax at the November 6, 2018 general election.

 

Staff Summary

                     During the August 8, 2018, Financial and Administrative Committee, the Committee considered and recommended that the County Board approve a resolution initiating and authorizing the submission of an advisory public question regarding a ban on the creation of a statewide property tax. 

                     Provisions within the Illinois Election Code and Illinois Counties Codes, respectively, enable a County Board to authorize the placement of an advisory question to the voters at the next regularly scheduled election.  The statutory timeline requires the submission of any questions for placement on the November 6, 2018 ballot by the County Board no later than August 20, 2018.

                     The advisory public question recommended by the Committee for placement on the November 6, 2018 ballot states: “Should the Illinois General Assembly amend the state constitution to ban the creation of a statewide property tax?”

                     The Resolution recommended by the Committee is attached with format changes highlighted for compliance with 10 Illinois Compiled Statutes (ILCS) 5/16-7.

RESOLUTION

 

WHEREAS, Pursuant to the Illinois Election Code, 10 ILCS 5/28-1 et seq., and the Illinois Counties Code, 55 ILCS 5/5-1005.5, by a vote of the majority of the members of the county board, the board may authorize an advisory question of public policy to be placed on the ballot at the next regularly scheduled election in the county; and

 

WHEREAS, the County Board hereby intends to submit to the residents of Lake County a public question of county-wide significance; and

 

WHEREAS, the County Board finds that this matter is germane and directly impacts on its governmental mandate, in that the State of Illinois has implemented the Property Tax Extension Limitation Law (PTELL), which directly impacts property taxation within the county; and

 

WHEREAS, the County Board believes it is in the best interest of residents of Lake County to move expeditiously as possible to submit this proposition to the voters at the next regularly scheduled general election to be held on November 6, 2018;

 

NOW, THEREFORE, BE IT RESOLVED BY THE LAKE COUNTY BOARD:

 

Section 1.  The above recitals are expressly incorporated herein and made part hereof as though fully set forth herein.

 

Section 2.  The County Board of Lake County does hereby initiate and authorize the following public question to be submitted to voters of Lake County at the regularly scheduled general election next occurring after the effective date of this resolution, on November 6, 2018:

 

“Shall the Illinois General Assembly amend the State Constitution to ban the creation of a new statewide property tax?”

Section 3.  The County Clerk of Lake County shall certify the public question referenced herein to the Commissioners of the Illinois Board of Elections in accordance with Article 28 of the Election Code.

 

Section 4.  This resolution shall be in full force and effect upon its passage.
