Staff Summary
• In conjunction with a proposed amendment to Lake County Code of Ordinances Chapter 172 that would authorize the issuance of a citation to a dog owner for failing to comply with dangerous, animal-aggressive or vicious restrictions, a revision is proposed to the Animal Care and Control Fees Schedule to implement a fine of $500 for these violations.
• In conjunction with a proposed amendment to Lake County Code of Ordinances Chapter 172 that would allow the enforcement of any Chapter 172 provision through the Administrative Adjudication process, a revision is proposed to add a fine of $100 for any violation of any other unspecified provision of Chapter 172.
• Any fines associated with these violations would be assessed by the Lake County Hearing Officer in accordance with the provisions of the Lake County Administrative Adjudication Ordinance.

RESOLUTION
WHEREAS, the Lake County Health Department is authorized to enforce a local ordinance regulating the care and control of animals, and the control of the spread of rabies to protect the public’s health; and
WHEREAS, the Lake County Board incorporated the Lake County Animal Care and Control Ordinance into the Lake County Code of Ordinances at Chapter 172 on January 15, 2013; and
WHEREAS, Chapter 172 of the Lake County Code of Ordinances also authorizes the Lake County Health Department to assess and collect fees for services described in this ordinance; and
WHEREAS, Chapter 178 of the Lake County Code of Ordinances codifies the establishment and amendment of a schedule of fees and charges for services provided by the Lake County Health Department under Title XVII of the Lake County Code of Ordinances; and
WHEREAS, the fees for Animal Care and Control services are contained in the Animal Care and Control Fees Schedule; and
WHEREAS, the Lake County Health Department has proposed amendments to the Animal Care and Control Fees Schedule that pertain to the assessment of fines for violations of the provisions of Chapter 178 of the Lake County Code of Ordinances; and
WHEREAS, the Lake County Board of Health has approved the proposed amendments to the Animal Care and Control Fees Schedule on March 28, 2018; and
WHEREAS, the Lake County Board of Health has recommended that the proposed amendments to the Animal Care and Control Fees Schedule be referred to the County Board for approval; and
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the amendments to the Animal Care and Control Fees Schedule herewith be approved and made a matter of Lake County law.
BE IT FURTHER RESOLVED, that the Lake County Clerk is hereby authorized to distribute certified copies of the amended Ordinance to the County Administrator, Comptroller, and the Executive Director of the Lake County Health Department.
