Ordinance amending Chapter 35, Section 35.36 Fees for Services Performed by Lake County Sheriff's Office (LCSO) by adopting a revised fee schedule for the LCSO.

Staff Summary
* The LCSO, in conjunction with Finance and Administrative Services (FAS) Department, completed a review of the cost of certain services provided by the LCSO.
* The services reviewed include:
o Service of process (including counter service)
o Service of summons, paper services, foreign services and subpoenas throughout Lake County.
o Replevin (return of property pursuant to court order)
o Evictions (removal of individuals pursuant to court order)
o Fingerprinting
* An analysis of the fees, which have not been increased since 2008, identified that the fee charged for these services does not cover the LCSO costs for providing that service.
* Based on a fee comparison completed by LCSO, the recommended fees are essentially in line with what Lake County municipalities and neighboring counties are charging.
* As a result of the review, LCSO recommends the adoption of a revised fee schedule with an effective date of December 1, 2017.

ORDINANCE

WHEREAS, Illinois law authorizes the Sheriff to charge fees for specified services conducted by said office; and

WHEREAS, the Illinois General Assembly passed and the Governor signed into law 55 ILCS 5/4-5001; and

WHEREAS, 55 ILCS 5/4-5001 provides that the County may increase the fees charged by the Sheriff if the County can demonstrate that said statutory fees are inadequate; and

WHEREAS, the Sheriff's Office in conjunction with County's Finance and Administrative Services Department completed a fee study analysis using 2017 financial data of the full cost of providing these services; and

WHEREAS, the results of said fee analysis combined with additional review showed fees being charged by the Sheriff are not adequate and do not reflect the full cost of providing those services; and
