Joint resolution brought by the Lake County State’s Attorney’s Office to establish the Lake County Children’s Advocacy Center Juror Fees Donation Pilot Program.

 

Staff Summary

                     This resolution creates a Lake County Children’s Advocacy Center Juror Fee Donation Pilot Program that will begin June 1, 2017 through December 31, 2018.

                     Under this pilot program, any grand juror or petit juror in Lake County may elect to have their juror fees donated to the Lake County Children’s Advocacy Center (LCCAC).

                     The legislation requires the Lake County Board to adopt, by resolution, rules and policies governing and effectuating the program.

                     Jurors will receive a form indicating that they have the option of donating the state mandated juror fees (that are paid by Lake County). 

                     All monies donated by jurors shall be transferred by the County to the LCCAC at the same time as it otherwise would have been paid to the juror.

                     All revenue from the donated juror fees shall be used exclusively for the operation of the LCCAC.

                     Lake County Board shall report to the General Assembly and the Governor after each calendar of the Pilot Program on or before March 31, 2018, and March 31, 2019 the following: the number of grand and petit jurors who earned fees; the number of grand and petit jurors who donated fees to this Pilot Program; the amount of donated fees to this Pilot Program; how the monies donated were used by the LCCAC; and the cost that was incurred by Lake County in implementing the Pilot Program.

RESOLUTION

 

WHEREAS, the Lake County Children’s Advocacy Center is a division of the Lake County’s State’s Attorney’s Office;

 

WHEREAS, Public Act 99-583 (55 ILCS 5/4-11001.5) established the Lake County Children’s Advocacy Center Juror Fees Donation Pilot Program (Pilot Program); 

 

WHEREAS, this Pilot Program allows any grand juror or petit juror in Lake County to elect to have their juror fees donated to the Lake County Children’s Advocacy Center;

 

WHEREAS, this resolution provides the rules and policies governing and effectuating the ability of jurors to donate their juror fees to the Lake County Children’s Advocacy Center;

 

WHEREAS, a juror may complete a form to elect to donate their juror fees and said form clearly states that the donation is optional;

 

WHEREAS, all monies donated by jurors shall be transferred by the County to the Lake County Children’s Advocacy Center at the same time a juror is paid pursuant to Section 4-11001 of the Counties Code who did not elect to donate their fees;

 

WHEREAS, all juror fees donated shall be used exclusively for the operation of the Lake County Children’s Advocacy Center;

 

WHEREAS, the Lake County Board shall report, on or before March 31, 2018 and March 31, 2019, to the Illinois General Assembly and the Governor the following information after the end of each calendar year of this Pilot Program:

 

1)                     The number of grand and petit jurors who earned fees during the previous calendar year;

2)                     The number of grand and petit jurors who donated fees to the Lake County Children’s Advocacy Center under this Pilot Program;

3)                     The amount of donated fees under this Pilot Program;

4)                     A report on how the monies donated in the previous calendar year were used by the Lake County Children’s Advocacy Center; and

5)                     The costs incurred by Lake County and the Lake County State’s Attorney’s Office during the previous calendar year to implement the Pilot Program.

 

NOW, THEREFORE, BE IT RESOLVED, by the County Board of the County of Lake, Illinois, that the County agrees to participate in the Lake County Children’s Advocacy Center Pilot Program; and

 

BE IT FURTHER RESOLVED, that the County agrees to adopt these rules and policies governing and effectuating the donation of juror fees to the Lake County Children’s Advocacy Center Pilot Program.
