R E S O L U T I O N
WHEREAS, the County of Lake (County) seeks to streamline and consolidate units of local government, where such consolidation is feasible and in the best interests of the residents of Lake County; and
WHEREAS, Public Act 99-783, which is codified at 70 ILCS 2805/33(b), provides as follows:
The County of Lake may dissolve the Fox Lake Hills Sanitary District, thereby acquiring all of the District's assets and responsibilities, upon adopting a resolution stating: (1) the reasons for dissolving the District; (2) that there are no outstanding debts of the District or that the County has sufficient funds on hand or available to satisfy such debts; (3) that no federal or State permit or grant will be impaired by dissolution of the District; and (4) that the County assumes all assets and responsibilities of the District. Upon dissolution of the District, the statutory powers of the former District shall be exercised by the county board of the Lake County. Within 60 days after the effective date of such resolution, the County of Lake shall notify the Illinois Environmental Protection Agency regarding the dissolution of the Fox Hills Sanitary District; and
WHEREAS, the Fox Lake Hills Sanitary District (“District”) was created under the Sanitary District Act of 1936, 70 ILCS 2805/0.1 et seq., to provide sewer service to an area of Lake County shown on the attached Exhibit 1; and
WHEREAS, in 1967, the District entered into a contract for sewer service with the County; and
WHEREAS, since at least 1985, the District has had no known corporate activity. There has been no board of trustees appointed to act and no taxes have been levied to support the District; and
WHEREAS, all of the assets that provide sewer service to the area that makes up the District are owned and operated by the County and its Department of Public Works; and
WHEREAS, the only known remaining asset of the District is a bank account at U.S. Bank in Fox Lake, containing a balance of approximately $10,635 and there has been no activity in that account other than periodic $1 transfers in and out to prevent the account from becoming dormant and escheating to the State of Illinois as lost or abandoned property; and
WHEREAS, the District has ceased to function as an entity necessary to providing sewer service to the area it was designed to serve and having been supplanted in its function by the County and its Department of Public Works; and
WHEREAS, the District has no known outstanding debts; and
WHEREAS, no federal or state permits or grants will be impaired if the District is dissolved; and
WHEREAS, the County is willing and able to assume all assets and responsibilities of the District; and
WHEREAS, the County finds that consolidation is feasible and in the best interests of the residents of Lake County.
NOW, THEREFORE BE IT RESOLVED by this Lake County Board that the Fox Lake Hills Sanitary District is dissolved by the authority granted in Public Act 99-783, codified at 70 ILCS 2805/33(b).
AND BE IT FURTHER RESOLVED that the proceeds of the account held at U.S. Bank in Fox Lake be transferred to the County, and that the account be closed.
