Staff Summary
• Recent state legislation provided for the Round Lake Sanitary District (District) to enter into an agreement with the County to transfer all its assets and responsibilities to the County and, upon dissolution of the District, for the County to assume the statutory powers of the District.
• By separate agreement, the County has been operating and maintaining the District’s physical infrastructure assets including the Midland Lift Station and Force Main, the Excess Flow Facility, and the Sunset Sewer Main for several years.
• This IGA transfers the ownership of this infrastructure as well as the property underlying the Excess Flow Facility and the Midland Lift Station. In addition, the District will transfer two unimproved residential lots on Dorothy Court and proceeds of its financial accounts in the approximate amount of $273,000.

R E S O L U T I O N
WHEREAS, the County of Lake (County) seeks to consolidate and streamline units of local government, where feasible and in the best interests of the people of Lake County; and
WHEREAS, Public Act 99-0783, codified as 70 ILCS 2405/27(c) provides for the Round Lake Sanitary District (District) to enter into an agreement with the County for the County to acquire the assets and responsibilities of the District and, upon dissolution of the District, for the County to assume the statutory powers of the District; and
WHEREAS, the County operates a Department of Public Works for the purpose of providing sewage distribution, transmission, and treatment services to various areas of the county; and
WHEREAS, the District owns and operates a system of sanitary sewers and other various physical assets; and
WHEREAS, by agreement the County has operated and maintained the District’s physical assets for several years; and
WHEREAS, the District seeks to enter into an agreement to dissolve itself and transfer all assets and responsibilities to the County; and
WHEREAS, the County is willing to assume these assets and responsibilities and finds that consolidation is feasible and in the best interests of the people of Lake County; and
WHEREAS, execution of this Intergovernmental Agreement must be authorized by Resolution of this County Board.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Chair of the County Board and the Clerk of said County be and they are hereby authorized and directed to execute the attached Intergovernmental Agreement to Facilitate the Dissolution of the Round Lake Sanitary District, in the form substantially herein.
