Joint resolution authorizing an agreement with Northern Illinois Gas Company (NICOR) to relocate a gas main along Nippersink Road, west of Wilson Road, appropriating $9,615,000 of ¼% Sales Tax for Transportation funds and $480,000 of County Bridge Tax funds for the roadway construction improvement and gas main relocation, and designated as Section 03-00070-06-CH.

R E S O L U T I O N
WHEREAS, Wilson Road, County Highway 7, is a designated route on the County highway system; and
WHEREAS, it would be beneficial to the safety and welfare of the motoring public if the intersection of Wilson Road at Nippersink Road would be improved including: soil stabilization, correction of super elevation, adding retaining walls, reconstruction, resurfacing and the addition of traffic signals and multi-use paths; and
WHEREAS, before a project letting can be held, an appropriation of funds is necessary; and
WHEREAS, NICOR has a gas main along Nippersink Road located within an existing easement in the area of the improvement; and
WHEREAS it will be necessary to relocate the said gas main to accommodate the upcoming improvement of Wilson Road at Nippersink Road; and
WHEREAS it will be necessary for Lake County to reimburse NICOR for the cost to relocate their gas main, estimated to cost $120,000; and
WHEREAS, NICOR and Lake County are desirous of entering into an agreement to provide for the relocation of said natural gas line setting forth the terms and obligations to each agency, a draft copy of which is attached hereto; and
WHEREAS, in order to start the relocation work, an appropriation of funds is needed.
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk and the County Engineer of Lake County are authorized and are directed to execute an agreement, and subsequent amendments, pertaining to the terms and conditions of the above-named utility relocation.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement, and any amendments, to be executed by the County Board Chair and the County Clerk.
BE IT FURTHER RESOLVED that there is appropriated $9,615,000 of ¼% Sales Tax for Transportation funds and $480,000 of County Bridge Tax funds for the roadway construction improvement and gas main relocation, and designated as Section 03-00070-06-CH.
