Ordinance amending Chapter 132, regulating the discharge of firearms in unincorporated Lake County.

 

Staff Summary

                     Pursuant to 55 ILCS 5/5-1117, counties have been given statutory authority to adopt an ordinance regulating or prohibiting the discharge of firearms.

                     There is a need to clarify the ordinance that regulates and prohibits the discharge of firearms related to the lawful act of hunting in compliance with the Wildlife Code within unincorporated Lake County.

                     This proposed amendment adds the following language to the Discharge of Firearms Ordinance: ‘This ordinance is not intended to limit the otherwise lawful act of hunting under the Illinois Wildlife Code.’

ORDINANCE

 

WHEREAS, 55 ILCS 5/5-1117, authorizes the County Board to regulate or prohibit the discharge of firearms within unincorporated Lake County; and

 

WHEREAS, the Lake County Board adopted an Ordinance on April 14, 2015 regulating the discharge of fire arms; and

 

WHEREAS, it has been determined that an amendment to the ordinance is appropriate to clarify the applicability of this county regulation on the lawful act of hunting under the Illinois Wildlife Code 520 ILCS 5/1.1 et seq.; and

 

NOW, THEREFORE, BE IT ORDAINED, by this County Board of Lake County, Illinois, that an amendment to the ordinance be adopted and be made effective October 11, 2016.
