Joint resolution authorizing the renewal of the Delegation Agreement between the Illinois Environmental Protection Agency (EPA) and the County of Lake for a solid waste management site inspection and enforcement program.

 

Staff Summary

                     On February 9, 1993, the County Board authorized the execution of a Delegation Agreement with the Illinois EPA for a solid waste management site inspection and enforcement program.

                     The Delegation Agreement has been renewed six times and the current delegation agreement, set to expire June 30, 2016, has been extended to July 31, 2016.

                     Funding for the inspection, investigation and enforcement program comes from the Solid Waste Management Tax Fund and an Illinois EPA Solid Waste Enforcement Grant.

                     The Illinois EPA has provided an Intergovernmental Delegation Agreement to renew the program for a five-year period, through June 30, 2021.

RESOLUTION

 

WHEREAS, Illinois Public Act 85-1195 states, in part, that if proceeds from a fee, tax or surcharge imposed by a local government on local landfills are to be used to conduct a local solid waste management site inspection and enforcement program, then the unit of local government must enter into a delegation agreement with the Illinois EPA pursuant to 415 ILCS 5/4(r) (1992); and

 

WHEREAS, the Lake County Board passed the Lake County Solid Waste Management Tax Ordinance in April 1989, amended July 13, 2010, pursuant to PA 85-1195;

 

WHEREAS, the Ordinance sets forth a priority protocol to be followed in expending the proceeds from the Tax, with one of the activities pursuant to that protocol being the funding of an inspection program for solid waste disposal facilities within Lake County; and

 

WHEREAS, on February 9, 1993, the County Board authorized the execution of a delegation agreement with the Illinois EPA for the purpose of implementing a local solid waste management site inspection and enforcement program; and

 

WHEREAS, in the same action, the County Board authorized an intergovernmental agreement with the Lake County Health Department providing for the implementation of the delegation agreement; and

 

WHEREAS, the Illinois EPA and County Board have renewed the delegation agreement six times and the current delegation agreement was set to expire on June 30, 2016; and

 

WHEREAS, on June 14, 2016, the County Board approved a request to the Illinois EPA to extend the current delegation agreement to July 31, 2016 while the Intergovernmental Delegation Agreement for renewal was being finalized; and

 

WHEREAS, the Illinois EPA has provided the Intergovernmental Delegation Agreement for a five-year renewal period that will expire on June 30, 2021.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Chair of the County Board is hereby authorized to execute the Intergovernmental Delegation Agreement between the Illinois EPA and the County of Lake regarding a joint and cooperative solid waste management site inspection and enforcement program, a copy of which is attached hereto and made part hereof.
