Title

Joint resolution requesting an extension of the existing Delegation Agreement between the Illinois Environmental Protection Agency (IEPA) and Lake County for the solid waste management site inspection and enforcement program.

 

Staff Summary

                     On February 9, 1993, the County Board authorized the execution of a Delegation Agreement with the IEPA for a solid waste management site inspection and enforcement program.

                     The Delegation Agreement has been renewed six times and the current agreement is set to expire June 30, 2016.

                     IEPA just recently provided the County with a revised Delegation Agreement, referred to as an Intergovernmental Agreement (IGA), for a five year period, set to expire on June 30, 2021.

                     The process to review, provide comments and collaborate with the IEPA, on the IGA, surpassed the timeframe to bring it to County Committees and the County Board Meeting on June 14, 2016.

                     The IEPA will allow for a request to extend the current Delegation Agreement to July 31, 2016.  This resolution accomplishes that extension.

RESOLUTION

 

WHEREAS, the Lake County Board passed the Lake County Solid Waste Management Tax Ordinance in April 1989, amended July 13, 2010, pursuant to Public Act 85-1195;

 

WHEREAS, on February 9, 1993, the County Board authorized the execution of a Delegation Agreement with the IEPA for the purpose of implementing a local landfill inspection and enforcement program; and

 

WHEREAS, in the same action, the County Board authorized an intergovernmental agreement with the Lake County Health Department providing for the implementation of the Delegation Agreement; and

 

WHEREAS, the IEPA and County Board have renewed the Delegation Agreement six times and the current Delegation Agreement is set to expire June 30, 2016; and

 

WHEREAS, on May 19, 2016, the IEPA provided a revised renewal Delegation Agreement, referred to as an Intergovernmental Agreement (IGA), for the next five year period, through June 30, 2021; and

 

WHEREAS, the time to review, provide comments and collaborate with the IEPA, on the IGA, surpassed the timeframe to bring the agreement to the County Committees and the County Board Meeting on June 14, 2016; and

 

WHEREAS, the Illinois EPA stated that if a county with an expiring delegation agreement will not be able to execute the new IGA on time, the county can submit a request, in writing, to extend their expiring delegation agreement.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Chair of the County Board is hereby authorized to request the IEPA to extend the current Delegation Agreement through July 31, 2016.
