Ordinance amending Chapter 170: Well and Water Regulations, of the Lake County Code of Ordinances.
Staff Summary
• Chapter 170 of the Lake County Code of Ordinances adopts, by reference, the Illinois Water Well Construction Code which the County is obligated to adhere by State Statute.
• A series of amendments by the State requires the County to amend the language in Chapter 170.
• Amendments include: provisions and requirements for permitting the construction modification, sealing and inspection of closed loop wells; provisions and requirements for permitting the modification of water wells; and selected setback distances were stricken as setback distances were added to or clarified in revisions to the Illinois Water Well Construction Code.
• Additional amendments include the registration of supplemental irrigation wells;.a supplemental irrigation well is defined in § 170.04 as “a non-potable water well that is used at a dwelling for residential watering and/or other outdoor purposes, where a separate water supply exists for drinking, culinary and sanitation purposes.”

ORDINANCE
WHEREAS, the Lake County Health Department is authorized to enforce a local ordinance regulating water well and closed loop well systems to protect the public’s health and safety; and
WHEREAS, the Lake County Board incorporated the Lake County Water Well Ordinance into the Lake County Code of Ordinances at Chapter 170 on February 10, 2015; and
WHEREAS, the Lake County Health Department is proposing amendments to this Chapter: and
WHEREAS, the proposed amendments regarding the permitting of closed loop well systems and the modification of water wells and closed loop wells are mandated by revisions to State regulations that are adopted by reference in the Chapter; and
WHEREAS, proposed amendments regarding supplemental irrigation wells are consistent with goals in the Lake County Health Department’s Strategic Plan and with the Lake County Framework Plan; and
WHEREAS, the Lake County Board of Health has approved the proposed amendments to Chapter 170 on August 19, 2015; and
WHEREAS, the Lake County Board of Health has recommended that the proposed amendments to Chapter 170 be referred to the County Board for approval.
NOW, THEREFORE, BE IT ORDAINED, by this County Board of Lake County, Illinois, that the amendments to Lake County Code of Ordinances Chapter 170 herewith be approved and made a matter of Lake County law.
BE IT FURTHER ORDAINED, that the Lake County Clerk is hereby authorized to distribute certified copies of the amended Ordinance to the County Administrator, Comptroller, and the Executive Director of the Lake County Health Department.
