The Illinois Department of Public Health (IDPH) Division of Laboratories provides clinical laboratory testing to the Lake County Health Department and Community Health Center (LCHD/CHC). LCHD/CHC receives the services at no cost while IDPH is able to use the aggregated data to benefit public health surveillance and oversight responsibilities.

 

IDPH is updating the agreements to clarify language related to HIPAA and HITECH. These Acts set standards for health care providers with respect to maintaining confidentiality of protected health information. For most LCHD/CHC sites, the only document to approve is the Intergovernmental Agreement (IGA). Some sites might also require the execution of a Business Associate Agreement (BAA).

 

The IGA includes updated language related to HIPAA and HITECH and includes a mechanism to obtain verified fax numbers for reporting test results. The BAA addresses how each party can utilize protected health information. The documents are essential to clear working relationship between our agencies.

 

We have some documents in hand currently awaiting approval from the Board of Health and expect more will be received in the future. Therefore, we request authority from the Board of Health to execute the documents as needed, consistent with our need for the service and the compliance by IDPH to provide accurate and timely test results and protect the protected health information (PHI).

 

Suggested Motion

To authorize the Executive Director or his designee to execute these agreements and future related agreements.
