Staff Summary
• The Village of Fox Lake has requested outside leadership to be appointed as Contract Acting Police Chief and Contract Acting Deputy Police Chief due to the vacancy created by the retirement of former Chief Michael Behan retire on August 28, 2015.
• The Intergovernmental Agreement is intended to be for temporary law enforcement personnel assistance to continue to protect the health, safety and welfare of the residents of Lake County, until the vacancy is filled.
• The Village of Fox Lake has agreed to pay the hourly rate of the deputies and to abide by the holiday schedule specified in the Lake County Sheriff’s Collective Bargaining Agreement and further to provide fuel and access to the facilities and Village police procedures to the Lake County deputies.
• The Lake County Sheriff has agreed the assigned staff of Deputy Chief Michael Keller and Sergeant Scot Kurek will use Lake County Sheriff’s vehicles to perform their official duties.
• The Village of Fox Lake has agreed to defend, indemnify, and hold harmless Lake County and the Lake County Sheriff for any action or dispute arising from the Intergovernmental Agreement and management of the Village of Fox Lake Police Department.
• The Village of Fox Lake has already begun the process of searching for a new Police Chief.

RESOLUTION
WHEREAS, the Village of Fox Lake has requested that the Lake County Sheriff provide two experienced deputies to serve, in a temporary capacity, as Village of Fox Lake Police Department Police Chief and Deputy Police Chief until the Village is able to appoint a new Police Chief; and
WHEREAS, the Village of Fox Lake and the County are authorized to enter into agreements to protect the health, safety and welfare of their respective residents and visitors; and
WHEREAS, Village of Fox Lake has begun the process of searching for a new Police Chief due to the retirement of former Police Chief Michael Behan; and
WHEREAS, the Lake County Sheriff has agreed to assign Deputy Chief Michael Keller to serve as “Contract Acting Chief” of the Village of Fox Lake Police Department and Sergeant Scot Kurek as “Contract Acting Deputy Chief” of the Village of Fox Lake Police Department; and
WHEREAS, Deputy Chief Keller and Sergeant Kurek shall remain employees of the Lake County Sheriff, compensated by the Sheriff and covered by the same Sheriff’s insurance and benefits in effect prior to the intergovernmental agreement; and
WHEREAS, the Village of Fox Lake has agreed to compensate Lake County for the temporary services of Deputy Chief Keller at a rate of $65.27 per hour and $49.21 per hour for the temporary services of Sergeant Kurek; and
WHEREAS, the Village of Fox Lake has agreed to compensate Lake County for any overtime approved by his supervisor Deputy Chief Keller and performed by Sergeant Kurek at an hourly rate of $73.82 and holiday time worked by Sergeant Kurek at a double time amount of $98.42 per hour, subject to the holiday schedule specified in the Lake County Sheriff’s Collective Bargaining Agreement; and
WHEREAS, the Village of Fox Lake has agreed to provide Deputy Chief Keller and Sergeant Kurek with necessary equipment and support to perform their official duties, included fuel and access to the Fox Lake Police Department facilities and procedures; and
WHEREAS, the Lake County Sheriff has agreed that Deputy Chief Keller and Sergeant Kurek will be permitted use of Lake County Sheriff’s vehicles and will report as necessary to the Village of Fox Lake President and Village Administrator on only the day to day administrative operations of the police department; and
WHEREAS, the Village of Fox Lake has agreed to defend, indemnify, and hold harmless Lake County and the Lake County Sheriff in any action or dispute arising from the intergovernmental agreement, violations of federal civil rights statutes, regulations and constitutional provisions; and
WHEREAS, the Village of Fox Lake agrees not to solicit or entice Contract Acting Chief Keller or Contract Acting Deputy Chief Kurek to terminate their employment with the Lake County Sheriff and agrees to not hire them as Fox Lake employees without written consent of the Lake County Sheriff during this agreement time period and for a two year period thereafter; and
NOW, THEREFORE, LET IT BE RESOLVED, by this County Board of Lake County, Illinois that the Chair of the Board and the Lake County Sheriff are hereby authorized to execute an Intergovernmental Agreement for Emergency Law Enforcement Personnel Assistance Between the Village of Fox Lake and the County of Lake, effective upon execution.
BE IT FURTHER RESOLVED, that the County Clerk is hereby directed to forward a certified copy of this Resolution to the Village of Fox Lake and the Lake County Sheriff.
