Joint resolution authorizing a contract modification with Clark Construction Group LLC of Chicago, Illinois, for Construction Manager at Risk (CMAR)Services with a Guaranteed Maximum Price (GMP) on the Lake County Courthouse expansion project for the infrastructure and interior Work as identified herein in the amount of $53,851,936.
Staff Summary
· The contract awarded to Clark Construction in April 2013 contemplates contract modifications for future work as a GMP on each distinct phase of construction for the Lake County courthouse expansion project.
· Clark Construction was awarded the first GMP in June 2014 as part of contract modification #1 for the first phase of work referred to as the ComEd enabling work which is complete.
· A second GMP was awarded to Clark Construction in September 2014 for the second phase of construction referred to as the site enabling work in the amount of $6,351,925, which increased the total contract amount from $843,469 to $7,195,394 which is currently underway.
· A third GMP was awarded to Clark Construction in April 2015 for the third phase of construction referred to as the core and shell work in the amount of $36,094,172 which increased the total contract amount from $7,195,394 to $43,289,566 which is scheduled to start this month.
· The infrastructure and interior GMP includes 29 primary bid packages which includes demolition, paving, site concrete, landscaping, drywall, millwork, miscellaneous metals, insulation, roofing, painting, electrical, HVAC, plumbing, fire protection, and various flooring, wall finishes, accessories and equipment.
· Upon execution of this contract modification #4, the contract for Clark Construction Group LLC will include the following components:

RESOLUTION
WHEREAS, On April 9, 2013, the Lake County Board authorized a contract for Construction Manager at Risk Services with a Guaranteed Maximum Price (GMP) for the Lake County courthouse expansion project including the first phase of services for Pre-Construction Services in the amount of $125,000; and
WHEREAS, Based on the success of the pre-construction services, Lake County intends to amend this contract to include a GMP for each distinct phase of construction relating to the Lake County courthouse expansion project; and
WHEREAS, On June 10, 2014, the Lake County Board authorized contract modification #1 for Clark Construction which included a GMP for the first phase of construction in the amount of $626,028 and an increase in Pre-Construction Services in the amount of $92,441; and
WHEREAS, On September 9, 2014, the Lake County Board authorized contract modification #2 for Clark Construction which included a GMP for the second phase of construction in the amount $6,351,925; and
WHEREAS, On April 14, 2015, the Lake County Board authorized contract modification #3 for Clark Construction which included a GMP for the third phase of construction in the amount $36,094,172; and
WHEREAS, Clark Construction has submitted a GMP for the Infrastructure and Interior work in the amount $53,851,936; and
WHEREAS, it is in the best interest of the County to move forward with this work as the next phase of the Lake County courthouse expansion project.
NOW THEREFORE BE IT RESOLVED by this County Board of Lake County, Illinois that $90,000,000 is appropriated in Fund 407, 2015 GO Alternate Bond Construction Project, in anticipation of the Series 2015 bond issuance scheduled to occur in June, in account 407-4300030-82010; and
BE IT FURTHER RESOLVED by this County Board that the appropriation previously approved in 101-1103920-82020 in April 2015 is rescinded in the amount of $35,608,373; and
BE IT FURTHER RESOLVED by this County Board that the Purchasing Agent is authorized to enter into a contract modification #4 with Clark Construction Group LLC of Chicago, Illinois in the amount of $53,851,936 to be charged to account 407-4300030-82010.
