* The proposed amendments are part of an overall package of ordinance amendments and proposed ordinances by the Lake County Sheriff's Office.
* The amendments would allow officers to enforce the ordinance using the Lake County administrative adjudication (AA) process (the chapter currently restricts enforcement actions to the circuit court), a proven efficient and effective means of seeking compliance for violations.

ORDINANCE

WHEREAS, the Lake County Board adopted the Lake County Tobacco Ordinance on November, 14, 2000; and

WHEREAS, the Lake County Board incorporated the Lake County Tobacco Ordinance into the Lake County Code of Ordinances at Chapter 177 on February 10, 2015; and

WHEREAS, the Lake County Sheriff's Office is making recommendations for changes to the Chapter to provide for AA as an enforcement mechanism of ?? 177.06 and 177.99; and

WHEREAS, pursuant to 55ILCS 5/5-43005, specified counties including the County of Lake were given authority to create a system of AA for any violation of a county ordinance except any violation of the Illinois Vehicle Code (or similar offense that is a traffic regulation governing the movement of vehicles and except for any reportable offense under Section 6-204 of the Illinois Vehicle Code); and

WHEREAS, on September 13, 2011, the Lake County Board adopted the Lake County Administrative Adjudication Ordinance; and

WHEREAS, the Lake County Board of Health has approved the proposed amendments to this Chapter on April 22, 2015.
