Staff Summary
* In accordance with Public Act 097-0673 regarding 55 ILCS 5/4-2002(c), the State's Attorney's Office began to charge a $2 fee paid by the defendant on a judgment of guilty or a grant of supervision for a violation of any provision of the Illinois Vehicle Code or any felony, misdemeanor, or petty offense to discharge the expenses of the State's Attorney's office.
* Per State statute, these funds must be deposited into a special fund designated as the State's Attorney Records Automation Fund for the specified purposes of hardware, software, research, and development costs and personnel related to establishing and maintaining automated record keeping systems.
* Unfortunately, a segregated Special Revenue Fund was not established at the time the fee was enacted. Therefore, the funds that have been collected, totaling $145,417.76 since June 2012, have fallen into General Fund fund balance.
* This resolution establishes the State's Attorney's Automation Fund, transfers collected funds from the General Fund to this new fund, and transfers the FY2015 budget from the State's Attorney's General Fund budget to the new fund.

RESOLUTION

WHEREAS, Public Act 097-0673 regarding 55 ILCS 5/4-2002(c) allows for the imposition of a fee to discharge the expenses of the State's Attorney's office for establishing and maintaining automated record keeping systems ; and
