Joint resolution authorizing an easement agreement between Lake County and the City of Waukegan for the Lake County Courthouse Expansion Project.

Staff Summary
* Lake County and the City of Waukegan entered into an Intergovernmental Agreement (IGA) for the Lake County Courthouse Expansion Project (LCCEP) which included provisions for an easement agreement.
* As part of the LCCEP, the County intends to construct, own and maintain certain permanent improvements to be located in or above the public right of way owned by the City including the tunnel, renovations to the existing elevated walkway, elimination of on street parking stalls in favor of streetscape elements and miscellaneous other improvements ancillary to the new court tower.
* The easement agreement will, in perpetuity, grant the County the right to own and maintain the improvements planned in the public right of way owned by the City of Waukegan.

RESOLUTION

WHEREAS, The County is undertaking a court expansion construction project identified as the LCCEP; and

WHEREAS, the LCCEP will be constructed on the County owned parcel of land in Waukegan on the southwest corner of Washington and South County Streets; and

WHEREAS, the County and the City have determined it to be mutually beneficial to enter into an IGA to address certain concerns and issues that are not otherwise addressed in the permitting process of the LCCEP; and

WHEREAS, the Parties entered into this Agreement pursuant to the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq. on April 7, 2014; and

WHEREAS, the IGA allows for improvements to be constructed, owned and maintained by the County in perpetuity in and above the public right of way owned by the City adjacent to the project site; and
