Chapter 177 of the Lake County Code of Ordinances, which is a Board of Health ordinance and was formerly known as Lake County Board of Health Ordinance Article XVIII, gives the Lake County Health Department the authority to issue permits and assess fees for the sale of tobacco products in unincorporated Lake County.  The Lake County Sheriff's Office, however, is the authorized enforcement agency for the provisions of the chapter, which includes conducting inspections and, where warranted, issuing citations.
 
The proposed revisions were requested by the Sheriff's Office and would allow officers to enforce the ordinance using the Lake County administrative adjudication (AA) process.  The ordinance currently restricts enforcement actions to the circuit court.  This proposed change is consistent with the inclusion of the authority to use the AA process in other Health Department ordinances and will provide the Sheriff's Office a proven efficient and effective means of seeking compliance for violations of the tobacco regulations.
