·      On August 8, 1995, the Lake County Board approved a resolution that appropriated $600,000 for the acquisition of right-of-way to reconstruct and realign Bonner Road, between US Route 12 and Darrell Road.
·      0.173 acres of excess property was acquired inadvertently due to an error in the legal description.
·      A quit claim deed in trust has been prepared for the purpose of conveying the 0.173 acres of property back to the rightful owner at no cost.

R E S O L U T I O N
 
WHEREAS, Bonner Road, County Highway 61, is a designated route on the County highway system; and
 
WHEREAS, on August 8, 1995, the Lake County Board approved a resolution that appropriated $600,000 for the acquisition of right-of-way to reconstruct and realign Bonner Road, between US Route 12 and Darrell Road, for the safety and welfare of the motoring public; and
 
WHEREAS, Lake County acquired a 0.844 acre parcel by condemnation which was designated as Parcel 0006; and
 
WHEREAS, it has been determined that 0.173 acres of excess property (pin# 09-22-400-005) in parcel 0006 was acquired inadvertently due to an error in the legal description and is not required for roadway purposes; and
 
WHEREAS, the Lake County Division of Transportation and the Public Works and Transportation Committee have deemed it to be in the best interest of the public, the County, and the adjacent owners to correct the error; and
 
WHEREAS, a quit claim deed in trust has been prepared for the purpose of conveying the 0.173 acres of property back to the rightful owner at no cost; and
 
WHEREAS, upon recordation of the quit claim deed in trust recorded in the office of the Lake County Recorder, the County will not be liable for future actions, claims or damages due to ownership of property not needed for transportation purposes.
 
NOW, THEREFORE BE IT RESOLVED by this Lake County Board:
·      It is hereby determined that it is necessary and desirable to dispose of this excess property by quit claim deed in trust to relieve the County of liability and to correct the adjacent owner's legal description.  
·      It is also hereby determined that the quit claim deed in trust executed by the County Board Chair and the County Clerk needs to be recorded in the office of the Lake County Recorder of Deeds to facilitate the disposal of the excess property.
