Joint resolution amending the subscription fee for license and use of the Enhanced Access to Court Records service.
Staff Summary
* Upon recommendation of the Lake County Executive Justice Council (EJC), on August 13, 2013 the Lake County Board approved a $240 maximum yearly subscription fee for enhanced access to Lake County Circuit Clerk's Office court records.
* The established fees are based on the staff support and maintenance required for this service, and are in line with other surrounding area counties' fees for similar services.
* The fee schedule previously presented and approved did not take into consideration the needs of non-profit charitable organizations as covered under Internal Revenue Service regulation 503(c)(3), that require the Enhanced Access to Court Records service.
* It is recommended that the fees associated with this service shall be waived for the first three users of an eligible 503(c)(3)organization, and that regular fees shall apply to any additional users within the same organization.

WHEREAS, the County Board of Lake County, Illinois approved on August 13, 2013 the maximum yearly subscription fee for enhanced access to court records of $240.
WHEREAS, the County Board of Lake County, Illinois and the Clerk of the Circuit Court of Lake County do not wish to unfairly burden charitable organizations that require the Enhanced Access to Court Records service.
WHEREAS, it is recommended that the fees associated with this service shall be waived for the first three users of an eligible 503(c)(3) organization, and that regular fees shall apply to any additional users within the same organization.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that fees for the first three users of an eligible 503(c)(3) organization requesting Enhanced Access to Court Records service shall be waived and that normal fees shall apply to any additional users within that same organization.
