Joint resolution authorizing execution of a First Amendment to the Regional I/I Facilities Intergovernmental Agreement (IGA) between Lake County and the Round Lake Sanitary District (RLSD).

Staff Summary
· The County entered into an IGA with the RSLD in November 2010 establishing the terms and conditions regarding the operation and maintenance of the Regional I/I Facilities on the RLSD property
· Certain terms included in the settlement agreement associated with the lawsuit between the Round Lake communities and the County necessitate that certain conditions in the County/RLSD IGA be amended.
· The amended conditions relate to repayment of advancements and financing of regional I/I improvements.
· The First Amendment to the IGA has been approved by the RLSD Board.
· This resolution authorizes the execution of a First Amendment to the Regional I/I Facilities IGA with the Round Lake Sanitary District.

RESOLUTION

WHEREAS, the County of Lake (County) owns and operates a regional sewer system that serves several municipalities in the Northwest Facilities Planning Area; and

WHEREAS, the County entered into an Agreement with the Round Lake Sanitary District (District) in 1977, in which the District agreed to lease the District’s property at Hawthorne Drive and Sunset Drive in Round Lake Beach (Property) to the County; and

WHEREAS, in November 2010, the County and the District entered into an Intergovernmental Agreement, establishing the terms and conditions upon which the County would operate and maintain the facilities on the District’s Property; and

WHEREAS, the County and the District have each determined that certain terms of the Intergovernmental Agreement should be amended; and

WHEREAS, the appropriate First Amendment to the Regional I/I Facilities Intergovernmental Agreement has been prepared, and ratified by the Board of the Round Lake Sanitary District; and
