Discussion on proposed text amendments to Chapter 151 of the Lake County Code of Ordinances and the associated text amendment review process relating to the regulation of unincorporated adult-use cannabis businesses.

 

Staff Summary

                     In 2019, following adoption of the Cannabis Regulation and Tax Act, Planning, Building and Development staff facilitated a regional Adult-Use Cannabis Task Force which developed a series of best-practice based model regulatory tools.

                     In early 2020, the Lake County Board enacted a moratorium on all adult-use cannabis businesses in unincorporated Lake County to allow additional time to study and consider potential community impacts of these establishments. The moratorium is set to expire on February 10, 2021.

                     The attached draft zoning amendments to the Lake County Code have been adapted from the Task Force’s model regulations and from additional research conducted during the County’s moratorium. The amendments would allow adult-use cannabis businesses in the unincorporated area subject to restrictions.

                     In advance of the moratorium expiration, staff will present a summary of the proposed amendments and a draft County Board resolution directing the Zoning Board of Appeals to conduct a public hearing on the same. These items will be brought back to Committee for formal action in February.
