Staff Summary
· The County and LRSD entered into a Restated and Amended agreement for sewage disposal services within the Northwest Lake FPA on July 10, 2010.
· The 2010 agreement allowed the LRSD to request amendments to the agreement based on certain provisions in other County agreements for wholesale sewer service in the NWFPA (most favored nations clause).
· This new agreement incorporates terms and conditions, which have been provided to other communities since the 2010 agreement.
· This resolution authorizes the execution of the amended agreement.

R E S O L U T I O N

WHEREAS, the County of Lake (County) owns and operates a system of interceptor sewers in the Northwest Lake Facilities Planning Area (NWFPA); and

WHEREAS, the Lakes Region Sanitary District (District) owns and operates a local sanitary sewer collection system in the NWFPA that discharges to and is transported to the Northwest Regional Water Reclamation Facility by the County interceptor sewer system; and

WHEREAS, the County and the District previously entered into a Restated and Amended Agreement for Sewage Disposal agreement for sewage treatment and disposal within the NWFPA dated November 16, 2004; and

WHEREAS, the County and the District previously entered into a Restated and Amended Agreement for Sewage Disposal dated July 15, 2010, which included a clause allowing the District to request amendments to the 2010 Agreement based on certain provisions in other County agreements for wholesale sewer service in the NWFPA; and

WHEREAS, this Agreement incorporates many provisions in other County agreements; and

WHEREAS, in order to conform with the terms and conditions under which continued Sewage Treatment services will be provided through the Northwest Regional Water Reclamation Facility, the County and District wish to enter into a new agre...
