Staff Summary
· CLCJAWA adopted a resolution expressing its intent to work towards an expansion of its membership.
· CLCJAWA has requested that prospective new members, and the County adopt non-binding resolutions agreeing to engage in good-faith discussions for the purpose of coming to an agreement under which new County service areas can be admitted to membership in CLCJAWA.
· Each entity will retain its right to come to a final, independent conclusion regarding membership expansion.

R E S O L U T I O N

WHEREAS, the County of Lake (the “County”) provides potable water service to various parcels within its jurisdiction, including the Grandwood Park and Fox Lake Hills service areas; and

WHEREAS, the provision of Water Service is a matter essential to the public health, safety, and welfare; and

WHEREAS, in order to evaluate collective concerns regarding the adequacy of supplies for Water Service, the County has worked cooperatively with various other providers of Water Service in Lake County, including without limitation the Village of Lake Villa, the Village of Lindenhurst, the Village of Volo and the Village of Wauconda (collectively, the “Parties”); and

WHEREAS, the Parties have been working with the Central Lake County Joint Action Water Agency (“CLCJAWA”) on the potential of obtaining Lake Michigan Water; and

WHEREAS, the CLCJAWA has determined that their system has available capacity to serve the Parties; and

WHEREAS, in order for the Parties to explore membership expansion in CLCJAWA, additional discussions need to ensue, based on a general set of agreed principles; and

WHEREAS, the CLCJAWA has approved the attached Resolution and Membership Expansion Principles, currently being considered by the Parties and the CLCJAWA, as Exhibit A; and
